농산어촌교육법(안)의 구조와 특성 분석

국문 초록

본 연구는 농산어촌교육법(안)의 구조와 특성을 분석하고자 하였다. 분석 대상은 그동안 국회에 상정된 농산어촌 교육 관련 11개 법안 중 유사한 법안들을 제외하고 5개 법안을 선정하였다. 분석은 법안 전문, 소관위원회의 검토보고서 및 회의록 등을 기초로 하여 법안의 목적과 조건 정비, 정책적 지원 구조, 가능성과 한계 등을 살펴보고자 하였다. 분석 결과는 다음과 같다. 우선 법안들은 공통적으로 헌법과 교육기본법이 지향하는 국민의 학습권을 보상적 평등 차원에서 강조하고 있다. 둘째, 법안들은 농산어촌 교육 전체에 관한 고민을 담고 있었다. 셋째, 정부의 적정 규모 학교 육성 정책 기준에 의해 작은 학교 간 통폐합을 유도하는 반면, 법안들은 작은 학교의 기준을 제시하면서 학교의 유지와 활성화 측면에서 접근하고 있었다. 마지막으로 향후 농산어촌 교육 지원을 위한 법 제정 시 타 법과의 상충, 타 법에 규정되어 있는 농산어촌 교육 관련 내용, 이미 정책이 추진되고 있는 부분 등을 어떻게 정리ㆍ조정할 것인지가 중요한 요인으로 작용할 것으로 분석되었다.

영문 초록

This study is analyzing the structure and the characteristic of agricultural, mountain and fishing villages education act under the premise that assuring systemicity and durability of educational revive is urgent matter through establishing education act. To do so, five bills including congresswoman Choi, SoonYoung is selected among eleven bills that has been brought in assembly. The content of analysis is the aim and focus of the bills, the structure of maintenance condition and supporting system and so on, and the possibility and the limitation of enactment of the law. The resources are relied on preamble of the acts and examination report and minutes of the remit committee. The result of analyzing is followed. First of all the emphasis of the acst is to assuring of the right to study. Second, the act is concerned about education of Agricultural, Mountain and Fishing villages as overall dimensions. That means the acts emphasized balanced development and regional competitive power through not only the schools and the students but also the opportunity for the residents. Third, the standard and the assessment toward the schools in Agricultural, Mountain and Fishing villages is different to the government. Notable is that the government is induce to merger and abolition with the standard, but the act is accessing in maintenance and vitalization. Finally, the way of arrangement and adjustment of contradiction with other laws, some part of act that already noted to other acts, policy that has been proceed would be key factors to enact of the law.
