영문 초록

With the development of democracy, the enhancement of citizen's sense of right, the right of petition be expressly stipulated in the Korean Constitution. In order to guarantee the right of petition, the ombudsman system has being organized or working. It has a meaning of a representative, agent, advocate or guardian in Swedish, has much sense as an institutional device to serve to preventing the infringement of citizens' freedom and right from the misuse and abuse of administrative power, to properly controlling administrative power, to solving the matter caused by infringement. Various ombudsman system inclusive of 'Ombudsman of Korea' is currently in operation In Korea. The purpose of this study is to analyze the function of the ombudsman system, for example as it is called that of the defence of right and controlling the administration in the Korean Constitution within the framework of a comparative study. As a result of the analysis, it will contribute to giving suggestions in systematization of the existing ombudsman system.
