국문 초록

민주주의 사회에서 환자의 권리 주장, 사생활 보호 및 자율성 확립은 아주 중요한 이슈가 된다고 말할 수 있다. 근래에 들어 생명윤리학자와 법학자들은 온정적 간섭주의에 기반한 전통적 의료윤리를 비난해왔다. 그들은 전통적인 온정적 간섭주의는 자율성 행사에서 환자의 이익을 아주 제한적으로 존중한다고 주장한다. 분명 우리는 생명윤리 분야에서 자율성의 승리 시대에 살고 있다. 환자의 자율성을 존중한다 함은 환자의 권리를 수용하고 그들의 인격적 가치와 신념을 제대로 인식하고 선택하여 그에 알맞은 행위를 하는 것이라 말할 수 있다. 어느 한 사람의 자율성을 위배한다는 것은 그 사람 자신의 목표가 아닌 다른 사람의 목표에 따라서 그 사람을 단지 수단으로 취급하는 것이라고 말할 수 있다. 하지만 의료 행위의 현실에서 특히 환자-의사의 관계에서 실제 무슨 일들이 일어나고 있는가에 대한 깊은 성찰이 필요하다. 적어도 어떤 환자들은 자기들에 대한 치료의 결정에 직접 참여하기를 원하기도 하지만, 더 많은 환자들은 자율성 주창자들이 원하는 것처럼 의료치료 결정에 따르는 부담감을 거부한다. 의료 행위 현장에서 환자들이 진정으로 원하는 것은 그들의 권리 주장이나 자율성 확립이라고 하기 보다는 의사와의 관계에서 신뢰와 진정한 인간관계의 형성을 원한다고 말할 수 있다.

영문 초록

In a society of participatory democracy, rights, and privacy, autonomy of the patient becomes an important issue. In recent years, bioethicists and lawyers have criticized traditional medical ethics basically based on the traditional dominance of paternalism, saying it scants the patient's interest in autonomy. Certainly, we live in the time of the triumph of autonomy in bioethics. To respect the autonomy of patients is to acknowledge their right to hold views, to make choices, and to act based upon their personal values and beliefs. To violate a person's autonomy is to treat that person merely as a means in accordance with other's goals without regard to that person's own goals. However, it is necessary to look into the real world what is happening in every day medical practice, especially in the patient-physician relationship. At least some patients desire and contend to make their own medical treatment decisions. Yet many other patients reject the full burden of decision autonomists would wish upon them. One might say of patients who decline to make their own medical decisions that they have exercised their autonomy in deciding not to decide. In clinical practice, what patients really desire is not exercising their rights and maintain their autonomy in medical decisions but crave for trust and passionate human relationship with physicians.
