영문 초록

Acquisition of Secondary meaning under the United States Lanham Act is a concept equivalent to the Acquired Distinctiveness by our Trademark Law of Art 6. Sec.2. This paper is intended to identify the Essence of Acquired Distinctiveness Concepts and its Standard of Judgment and Proof thereof through comparison to the nature and its meaning obtained secondary meaning under the United States Lanham Act. Further, try to clarify the position of registered trademark acquiring distinctiveness under Trademark Law of Art 6. Sec.2. and more clearly identify what kind of test is required in order to decide whether a non-traditional mark has acquired a secondary meaning. Especially, it is focused on the scope of free and fair using between primary meaning and secondary meaning among competitors after acquired a distinctiveness by reviewing Article 51 of the Trademark Law. Furthermore, reviewing in light of what is inevitably associated with the criteria and the methods of proving them in detail with reference to the example of the U.S. cases. Especially, consumer survey is discussed in detail as an important direct proof.
