불법조업 외국어선에 대한 단속 시 해양경비안전본부의 무기사용에 관한 법적 고찰

국문 초록

대한민국 배타적 경제수역에서 중국어선에 의한 불법조업이 지속되어 수산 자원이 고갈되는 한편, 조업분쟁이 발생하고 있다. 특히, 중국어선들의 불법조업이 조직화․폭력화되면서 단속공무원들의 사망 등 인명사고가 지속적으로 발생하고 있는 현실이다. 이에 한국 정부에서는 문제 해결을 위해 다각도의 노력을 경주해왔는데, ’08년도 ‘해상공권력 강화 대책’, ’11년도 ‘불법조업 근절 종합대책’ 뿐 만 아니라,‘12년도에는 국민안전처 해양경비안전본부(구, 해양경찰청)에서 「해양경비법」을 제정하여 불법조업 단속을 위한 추적․나포, 무기 사용 요건 등을 정립하기 이른다. 이러한 노력에도 불구하고 중국 연안 해역에서의 수산자원 고갈에 따른 중국어선의 대한민국 해역에서의 불법조업은 아직까지도 그치지 않고 있다. 불법조업으로 인한 경제적 이익이 있는 한 중국어선의 이러한 행위는 쉽게 근절되지 않을 것이며, 한국 정부는 외교적 노력을 병행하는 동시에 적법한 단속을 통한 법질서 확립에 노력해야 할 것이다. 국민안전처 해양경비안전본부는 그동안 해양경찰청이라는 독립된 외청의 형태로 불법조업 현장의 최일선에서 법을 집행하며, 적절한 무력을 행사해왔다. 최근에는 철갑, 쇠창살 등으로 중무장하고 집단적으로 폭력 저항하는 불법조업 중국어선에 대해 새로운 단속장비를 도입하고 전술체계를 발전시켜 나가고 있다. 하지만, 이러한 새로운 장비와 전술, 법률 등이 국제적으로 통용되는 협약과 관례․판례에 적합한지?, 외교적 분쟁의 소지는 없는지? 등을 사전에 고찰하며 대비책을 마련할 기회가 부족하였다. 따라서 본 연구는 그 동안 국내․외에서 발생한 불법조업 단속 관련한 국제 분쟁이나, 외교적 마찰사례 등을 살펴보고, 신설되는 해양경비안전본부에 필요한 국내법 및 제도 등의 개선방안을 제시하기 위한 것이다.

영문 초록

Republic of Korea maritime resources is facing depletion at the economic exclusive zone due to Chinese flagged illegal fishing vessels along with fishery disputes. Especially Chinese illegal fishing is becoming more organized and aggressive resulting in increase of death and injury toward enforcement officers. Republic of Korea Government has discussed this issue with diversity of solutions, in 2008 the announcement of "Countermeasure of strengthening maritime public powers" and in 2011 "Multi-Solution for eradication of illegal Fishing". Korea Coast Guard established "Maritime Guard Act" in 2012 to establish the need to pursuit, arrest, use of weapon toward enforcing illegal fishing. Although with numerous effort, depletion of maritime resources at Chinese coastal area has enforced illegal Chinese fishing vessels to conduct illegal fishing at Republic of Korea territory. Chinese illegal fishing act will not stop while providing economic benefit to China and Republic of Korea Government will need find a appropriate solution while enhancing diplomatic status with China. Korea Coast Guard has been the leading agency to enforce illegal fishing on the scene by using necessary force. Nowadays Korea Coast Guard adopted new enforcement equipments and tactics to encounter with heavily armed illegal Chinese fishing vessels with steel plate amour and spears by resisting our enforcement by using organized violence. However we had less opportunity to discuss our counter-measures regarding to international conventions and diplomatic disputes. This study is aims to review domestic and international illegal fishing act related with international and diplomatic disputes. Adding on this study will provide guidelines to improve domestic laws and policy related with illegal fishing acts.
