이문제(里門制)와 조선 초기 범죄예방활동에 관한 고찰

국문 초록

조선 초기 명화적(明火賊) 등 각종 범죄가 급증하자 국가에서는 형벌을 강화하고, 순군(巡軍) 등 순찰조직을 확대하는 등 범죄를 예방하고 통제하기 위한 갖 가지 제도와 조치들을 시행하였으나 큰 효과를 거두지 못했다. 세조 대(代) 들어서도 범죄 밀고함을 새로 만들고, 호패법을 다시 시행하고 경수소(警守所)를 확대하는 등 다양한 범죄 대책을 실시했음에도 불구하고 범죄가 좀처럼 줄어들지 않자 이문제(里門制)를 시행하기에 이르렀다. 조선 초기 행정의 기초 단위로 자리 잡은 이(里) 안으로 들어가는 어귀에 외부인의 출입을 통제하고 범죄를 예방하기 위해 이문(里門)을 설치하였던 것이다. 기존의 범죄 관련 대책이 순군(巡軍) 등 국가에서 전담한 데 반해 이문(里門)은 민간인들에게 출입통제의 책임을 맡겼다는 점에서 다른 대책 및 방안들과 큰 차이점을 갖는다. 아울러 이문제(里門制) 실시 결과 범죄가 감소하는 등 시행 초기에는 소기의 성과를 거둔 것으로 평가된다. 그러나 관(官)의 관리 감독 소홀과 돌아가면서 직숙(直宿)을 해야 하는 주민들의 불만들로 인해 철저한 시행에 어려움을 겪게 되었다. 더욱이 상업경제의 발달로 도성에 인구가 급증하면서 택지가 크게 부족하게 되었고, 시장과 노점상의 증가로 인해 다른 거주지와 분리된 독립 거주공간으로서의 이(里)의 존속은 어려워졌다. 공간의 부족은 자연스럽게 이문(里門)과 연결 담장의 훼손으로 이어졌고 이문(里門)은 더 이상 외부인의 출입을 통제하고 범죄를 막는 범죄예방의 기능을 행사하지 못하게 된 것이다. 그렇지만 이문제(里門制)는 다른 범죄예방 및 통제 대책과 달리, 관(官)과 민간의 협력치안 형태를 갖추고 범죄예방과 통제의 효과를 거두었다는 사실에서 지역사회경찰활동의 초기 형태를 엿볼 수 있게 하며, 현대 경찰활동의 차원에서도 시사하는 바가 적지 않다. 국가의 일방적인 범죄대책의 마련과 시행만으로는 범죄예방과 통제에 한계가 있을 수밖에 없으며 결국 보다 효과적이고 효율적인 범죄예방 및 통제를 위해서는 민간과의 원활한 협력이 필요하다는 점을 이문제(里門制)를 통해 역사적으로도 확인할 수 있는 것이다. 이와 함께 근대이전 범죄예방과 통제관련 역사적 기록과 연구가 매우 부족한 현실에서 조선 초기 이문제(里門制)의 실시와 관련 기록은 소중한 사료(史料)가 되며 경찰사(警察史)의 측면에서도 큰 의미를 갖는다고 할 수 있다.

영문 초록

Confronted by the crime wave during the early Chosun Dynasty, the Chosun government attempted to control crime by means of various measures and policies including enhanced punishment and the reinforcement of patrol officers, which proved to be ineffective. Although King Sejo ordered to install the boxes for informers, enforce the resident registration, and increase the number of night watches, crimes were not reduced. The surge of crime and the failure of crime control policies paved the way for the creation of the Li-Mun system. The Li-Mun system mainly consisted of the main gate called Li-Mun an that was the only gate to enter the village surrounded with walls. The vigilantes from village residents checked all residents and guests at the main gate for the purpose of crime prevention. The Li-Mun system was peculiar in that it was maintained not by the government but by the residents, although the government regulated and monitored the residents' control of the system. The Li-Mun system was successful for crime control at least for the early period. The problem of government regulation and the residents' complaints from the shift system caused to prevent the efficient control of the Li-Mun system, engendering the resurgence of crimes. The increase of population in the capital also contributed to the failure of the Li-Mun system because a need for new houses and markets was so great that Li-Mun(a main gate) and the walls surrounding a village were collapsed. Since the Li-Mun system was based on complementary relationship between the government and the village residents, the system was different from other systems or measures for crime prevention and control at that time, which was significantly important in terms of police history. In this context, thus, the Li-Mun system seemed to be regarded as the prototype of community policing. The Li-Mun system was also important because it provided invaluable historical data for the analysis and explanation of the criminal justice system during the early Chosun Dynasty.
