식품범죄 실태 및 대응체계 문제점 분석을 통한 정책적 제언

국문 초록

식품은 인간의 생존에 있어 필수적 요소로서 식품의 위생과 안전은 국민의 건강과 삶의 수준을 결정하는 지표이자, 국가의 당연한 책무이다. 특히 오늘날 불량식품은 인간의 건강을 위협하는 최대의 요소로 인식되고 있으며, 소셜 미디어(Social media) 등을 통해 사회적 이슈로 쉽게 점화되고 있다. 반면 식품제조업체의 영세성, 복잡한 유통경로와 관리기관과 법령의 다원화 등으로 인해 경찰의 지속적인 단속에도 불구하고 불량식품은 근절되지 않고 있다. 또한 식품범죄는 특수성 및 전문성을 갖고 있기 때문에 수사기관의 단속만으로는 한계가 있다. 따라서 이 연구에서는 우리나라 식품범죄의 대응체계의 문제점을 단속체계를 중심으로 면밀히 분석하고, 식품범죄 근절을 위한 몇 가지 정책적 제언을 다음과 같이 제시하였다. 첫째, 식품사범 단속체계를 개선해야 한다. 이를 위해 충분한 단속 및 수사인력의 증원과 전문화, 단속시스템의 효율화, 내부고발의 적극적 유도, 강제적 자기규제(enforced self-regulation) 등이 필요하다. 특히 식품의약품안전처 소속위해사범중앙조사단의 지방식품의약품안전청 근무인력을 증원하고 정규직제로 전환하는 것을 검토해야 한다. 또한 일반사법경찰과 특별사법경찰간의 상호협력과 함께 식품의약품안전처와 지방자치단체 간 협력체계도 구축함으로써 불량식품이 적발되었을 때에 공신력 있는 기관이 안전성을 검증하고, 불량식품으로 판명된 회사 제품을 공개하며, 그 불량식품을 조기에 회수하고 폐기할 수 있는 시스템 구축이 중요하다. 둘째, 식품사범의 단속에 따른 제재체계를 발전시켜야 한다. 식품사범의 재범을 막기 위해 부당이득에 대한 환수ㆍ몰수가 필요하며, 식품사범 중 재범자에게 대한 '삼진아웃제'나 '식품업체 대표자 추적관리제'를 함께 시행할 필요가 있다. 이밖에도 법정형의 가중처벌, 벌금형의 인상, 선고형 비중 확대, 법인 처벌 체계의 마련이 필요하다. 셋째, 식품안전관리체계의 개선대책으로 국무총리실 '식품안전정책위원회'와 '식품의약품안전처'가 중심이 되어 식품안전 및 불량식품 단속체계를 통합관리토록 해야 한다. 또한 식품안전기본법과 식품위생법을 대폭 정비하여 애매모호한 법률용어를 정비하고, 식품안전 관리감독 책임을 명확히 함으로써 사고발생 시신속한 대응체계를 구축할 필요가 있다. 아울러 현재 식품의약품안전처 내에 설치된 '식품의약품안전평가원'에게 타 부처 소속 위해평가기관들을 총괄, 조정 및 중재하는 임무를 부여하고 가급적 식품의약품안전처로부터 독립시킬 필요가 있다.

영문 초록

It goes without saying that eating is so essential for human's existence that food safety and hygiene, as indicator to determine people's health and level of their lifestyle is national government's responsibility. Recently, impure and harmful foods are highly regarded as a main threat of people's health and it triggers social issue through different kinds of social media. Meanwhile, despite of government's regular regulation, it is hard to uproot unsanitary food product because of complicated distribution channels, inadequate condition of food factories and too many control agencies and multifarious laws. Moreover, general law enforcement authorities show their limitation to control food crime since the crime itself has characteristic profession. Consequently, this research recommends several political alternatives to put food crime an end while analysing on the food crime's actual condition and its countermeasure systems in Korea. First, the regulation systems of any violations in hygiene and food related laws must be improved. For the improvement, other factors are also needed such as increasing investigation members and training them specialized, efficiency oriented regulations, active leading toward a whistle blower, and strong self-regulation. Cooperation between the public police and the special judicial police ought to be founded and Food & Drug Safety Ministry and local governments should be strongly supported each other. Secondly, sanctions of food crime must be more strengthened. On the purpose of blocking a second offender, the 'strike out' and the 'follow up survey of foodstuff owner' systems must be considered to act. other punishing systems like raising fine, extra adding punishment, sentence extension, and penalty on juridical corporation are also needed. Finally, for an improvement of food safety management system, the Food Safety Police planning Committee under the Prime Minister and the Food & Drug Safety Ministry should be the main combinating controller to deal with not only food safety but also impure food regulations. It is necessary to improve various food safety basic laws and food sanitary laws in order to determine of which departments would take responsibility when food crimes happen and rapid countermeasure systems should be constructed.
