경비업법상 경비지도사의 법적 지위와 제도적 발전방안

국문 초록

경비지도사 제도는 경비원의 자질향상을 도모하기 위하여 경비원의 지도ㆍ감독 및 교육을 전담하도록 하기 위한 것이다. 경비지도사는 경찰과 민간경비의 연결고리로서 그 활용가치가 충분함에도 불구하고, 이를 제대로 활용하지 못하고 있는 실정이다. 민간경비의 미래는 경비원의 자질향상에 있는데, 이와 같이 경비원 개인마다 경비업에 대한 자부심을 심어주고 업무에 정진할 수 있도록 하는 것은 경비원 개인을 넘어서서 그를 지도ㆍ감독하고 특히 전문성 있고 진정성 있는 경비지도사의 지도와 감독 그리고 교육을 통해서만 가능하다. 이러한 직무가 경비지도사에게 기대되는 역할이며 미래의 민간경비산업의 존립은 물론 사회적ㆍ경제적 위상을 결정하는 핵심적 요소임은 아무도 부인하기 어렵다. 본 연구는 먼저 경비지도사 제도의 연혁과 제도적 취지를 살펴본 후에 경비지도사와 동 제도의 현황을 관련자료 분석을 통해 알아보았다. 민간경비의 현장관리자인 경비지도사의 역할을 중시하면서 경비지도사 제도가 올바르게 운영되기 위한 노력으로 경비원과 차별화되는 경비지도사의 자격요건의 강화, 경비업무 종사경력자에게 경비지도사가 되는 길을 넓혀주기 위해 일정한 민간경비종사 경력자에 대한 경비지도사 1차 시험 면제의 필요성, 경비지도사 활동의 내실화를 위한 경비지도사 배치기준상의 경비원 수의 축소, 중복선임의 제한 및 전임제 경비지도사 선임으로의 전환, 경비지도사 자격의 질적 관리를 위한 보수교육의 법정화, 그리고 경비지도사 선임의 대상영역의 확대에 대하여 살펴보았다. 무엇보다도 이러한 경비지도사 제도의 몇 가지 한계를 뛰어 넘기 위해서는 제도의 입법취지에 맞도록 그 공익성(公益性)도 보다 강화하는 쪽으로 입법태도를 전환하는 것이 필요하다는 점에서 '컴플라이언스 기능' 강화를 통한 경비지도사의 공적 기능 재정립에 주목하였다. 이러한 공익성의 일정한 확장은 궁극적으로 경비지도사협회가 「경비업법」상의 법정단체로 자리매김하는 데에도 든든한 명분과 논리를 제공하고 경비지도사의 실질적인 역할수행과 권익보호에 도움이 될 것이라고 본다.

영문 초록

The private security instructor system is responsible for the guideㆍsupervision of the guard and education in order to promote the elevation of qualification of the guard. This practical value is enough as the linkage of police with the private security, but the private security instructor system isn't utilized properly. The future of the private security is in the elevation of capacity of the guard. It exceeds the guard person of themselves, it is possible with the guide of the private security instructor which supervises, the professionalism, the authenticity and supervision through the education to implant the pride of the private security industry for the guard and devote to their job. It is difficult for nobody to deny the role that is expected from the private security instructor and the kernel element deciding on the socio-economic status as well as the existence of the future private security industry. This research inquired into the present condition of the private security instructor and it's system through related data analysis after examining the history of the private security instructor system and systematic purpose. In addition, Intensifying of the qualification of the private security instructor who is the field manager of the private security, we suggest necessity of the private security instructor's differentiation from the guard in qualification requisite, exemption at the primary examination of private security instructor test in order to broaden the road for the guards engaged in the careers of private security industry to be the private security instructor, reduction of the number of the guard that is to be a criterion which determine the number of the private security instructor's designation, limitation of overlapping nomination and transition into full-time nomination, legislative institutionalization of the refresher training for the qualitative administration of the private security instructor qualification, and enlargement of the borders of private security instructor designation. It paid attention to the public function reestablishment of the private security instructor through 'the compliance function' intensification, necessary to convert the legislative attitude so that jump over the several limits of this private security instructor system. To be The Korea Security Instructor Association ultimately developed into the a legal entity in the security industry law and to be fixed expansion of this common benefit, 'the compliance function' to provide the strong justification and logic, to promote the substantial Role performance of the private security instructor and to protect the rights and interests is very helpful.
