미국경찰체제에 대한 비판적 고찰 및 시사점

국문 초록

미국은 영국을 위시한 유럽의 이주민들이 정착하면서 국가의 형태를 갖추기 시작하여 세계 최강국으로 성장한 역사를 지니고 있다. 미국의 경찰제도는 소규모 자치지역ㆍ도시에서 시작하여 주 그리고 연방단위로 발전하였다. 따라서 매우 다양한 형태를 띠고 있으며 그로 인해 국가 전체를 통합하는 체제로 나아가지 않았다. 미국의 경찰체제는 많은 국가에 영향을 준 모델이 되었을 뿐 아니라 과학수사를 바탕으로 한 형사사법의 과학화에 기여한 바가 크다. 그러나 미국사회의 뿌리 깊은 갈등요인과 사회문제를 극복하기에는 한계를 드러내 현재 미국의 치안상황은 상당히 불안한 실정이다. 민간의 총기보유에 의해 빈번히 발생하는 총기난사 사건 등 총기 이용 범죄, 대규모 갱단, 마약 확산, 인종 간 갈등과 테러 문제 등 해결해야 할 현안과제가 산적해 있다. 그러나 미국경찰은 비효율적인 관할 중복이 발생하며 통합적 관리가 불가능하여 체계적인 범죄예방 대책을 수립하기 곤란하다. 오히려 미국의 불안한 치안상태를 극복하기에 가장 적합하지 않은 체제가 바로 미국식 경찰체제라고 볼 것이다. 이러한 미국의 상황은 미국의 치안상태와 유사해져 가는 한국에 시사하는 바가 크다. 자치경찰체제 도입을 지속적으로 논의해 온 한국은 현재의 치안상태와 남북통일을 대비한 치안능력 강화를 준비해야 하기 때문이다. 따라서 사회안전망 구축을 위한 국가경찰의 통합적 관리 시스템을 구축하여야 하고 특히 테러 및 유사테러 범죄를 사전에 예방할 수 있도록 체제를 정비해야 한다. 미래의 사회적 안전 확보를 위해서는 청소년이 안전하게 성장할 수 있도록 학교내외에서의 폭력과 비행을 근절시킬 수 있도록 최대한의 노력을 기울여야 한다.

영문 초록

Starting in small-sized autonomous regions and cities, the American police system has been developed at state and federal levels. Therefore, it shows several forms to be insufficient in advancing into the system to unify the whole nation. The American police system has been a role model affecting a number of countries as well as greatly contributed to scientification of criminal justice based on scientific crime investigation. However there are limitations on solving out deep-rooted conflicts and social problems in American society so that its security matters reach a serious level. There are still lots of serious problems to be addressed such as crimes committed with firearms including the frequently-occurred shooting rampage firing at random owing to the privately-owned firearms, a large scale criminal gangs, spread of drug, racial conflicts and terror incidents. Due to the American police system's redundant jurisdiction, however, it is impossible to carry out an unified management and also it is difficult to come up with a systematic crime prevention measure. The current situation in American society gives great implications to Korea going after the American police system troubled with security vulnerability. Therefore it is needed to establish an unified management system for making a more stable social security net. In particular, it is urgent to maintain a system to prevent terror and terror related crimes.
