국문 초록

2014년 경찰청 사이버안전국 자료에 의하면, 사이버공간에서 발생하는 범죄유형을 사이버테러형 범죄와 일반사이버 범죄로 구분하고 있다. 최근 10년간 발생한 사이버테러형 범죄는 연평균 16,000여건 발생, 12,000여건 검거하는 것으로 나타났다. 사이버공간에서 발생하는 사이버테러의 유형과 대상은 불특정 다수의 개인과 단체 그리고 범위가 확대되고 있으며, 공격수단은 인터넷, 이메일, USB, 공유폴더 등을 통해 다양하게 이뤄지고 있다. 공격수단 또한 장기적인 잠복기를 통한 공격코드 삽입, 정상을 가장한 조간된 파일 유입ㆍ공격, 취약점을 이용한 악성코드 유포, 소셜 댓글서비스에 이용되는 링크를 통해 악성코드를 유포하는 등 지능화ㆍ고도화된 방법으로 이루어져 사이버위협은 갈수록 커지고 있다. 최근 국회에서 발의된 사이버테러와 관련된 법률안의 가장 주요한 차이는 공공부문과 주요 민간부문을 포함한 사이버테러 방지 및 위기관리 책임기관에게 각종 책임과 의무를 부여하고 이에 따른 벌칙 규정, 책임과 의무를 주로 중앙행정기관, 지방자치단체 및 공공기관에 부여하고 있다는 점 등이라고 할 수 있다. 결국, 사이버테러의 위협은 공격주체와 루트 그리고 수단이 명확하게 나타나지 않는 잠재적인 위험성이 상존하고 있고, 이러한 사이버테러가 국가안보와 직결되어 있다면, 그 피해규모도 추정되지 않을 만큼 심각하기 때문에 국민의 생명과 신체 그리고 재산보호를 위해서라도 사이버대테러 활동을 위한 기본법 제정이 필요하다.

영문 초록

According to the 2014 Korean National Police Agency Cyber Bureau data, cyber crime type distinguish cyber-terrorism and common crime in cyberspace, Cyber terrorism offenses occurred over the past 10 years alone has been shown to occur conditions caused an annual average of 16,000. Type of cyber terrorism occurring in cyberspace and the target is expanding the range and an unspecified number of individuals and organizations. Also Cyber attacks means the Internet, email, USB, etc. are being made in various ways through a shared folder. In addition, intelligent and sophisticated way to spread malware via a link that is used for long-term incubation with attack code insertion, the top most one morning and file incoming attacks, malicious code using a vulnerability spread, Social Services Comments Cyber threats are growing increasingly composed. The main difference between cyber-terrorism and related legislation initiative in the National Assembly as follows: Cyber-terrorismand crisis including the public sector and major private sector given the duty and responsibility to manage the various authorities and accordingly penalty regulations, responsibilities and obligations, the central government and local governments public institutions. Finally, the threat of cyber-terrorism is a potential risk of the subject and the route and means of attack does not appear clearly. Cyber terrorism is directly related to national security, It need for enact the Basic Law for the life and physical protection of people.
