영문 초록

The Madrid Protocol relating to the Madrid Agreement concerning the international registration of marks has been effective since April 10, 2003 in the Republic of Korea. Al- though the new international registration system under the Madrid Protocol has various advantages, the Korean applicant and his representative does not fully use the new system. Complex application procedure and language problem make them hesitate to use the new system. The main purpose of this paper is to help them under- stand every facet of the Madrid system by providing the ex- periences accumulated at the workplace from the entrance of the Madrid Protocol by Korea in 2003. In the procedure of the Office of origin, they need to search the pre-applied and pre-registered marks using the Madrid Express and the trade- mark offices of the countries where they want to have their marks registered. They also have to prepare the central attack from the Office of origin to prevent their marks from being cancelled in the designated contracting country. In the procedure of the Office of designating contracting parties, they also need to take the maximum advantage of such devices as limitation, replacement and transformation, and they will find the new system to be a cost-effective and user-friendly one.
