국문 초록

이 글은 비거래적 성범죄를 중심으로 성형법의 경향을 분석하고, 이런 경향이 안고 있는 문제점을 지적하고 있다. 이로써 신중한 성범죄대책을 촉구하고, 성형법의 해석에 의미있는 기여를 하며, 나아가 성형법의 올바른 체계를 마련하는데 일조하려고 한다. 성형법의 혼란과 모순 및 오류는 기존 성범죄의 구성요건과 법정형에 대한 충분하고도 면밀한 검토를 하지 않고 성급하게 성적 행위를 빈틈없이 범죄화하면서, 사안의 경중을 가리지 않고 지속적으로 강한 처벌만을 추구해왔기 때문에 발생한 것이다. 이 과정에서 성범죄피해자의 의사를 넘어서서 국가형벌권이 발동되는 형사절차가 완성되었다.

영문 초록

In this article criminal law about sex mean penal provisions related to sexual action. A so-called 'Individual Penal Law' besides Criminal Act include the penal provisions related to sexual action. Military Criminal Act, Act on the Punishment of Prostitution Recommendation(Anti-Prostitution Act), Act on Special Cases concerning the Punishment, etc. of Sexual Crimes, Act on Protection of Children and Juveniles from Sexual Abuse, Act on Promotion of using Information and Communications Network and Information Protection, Child Welfare Act come under 'Individual Penal Law'. This essay analyses trend of criminal law about sex and point out problems that trend provokes. The main purpose of this essay is to emphasize that prudent countermeasure against sexual crime should be pursued. Additional purpose of this essay contributes systematic reform and interpretation of criminal law about sex. The contents of this article is as follows - Introduction - Refinement of the crime configuration requirements and The confusion of system and interpretation - Reinforcement of criminal sanctions and Overloading and disabling of sentencing - Mandatory criminal procedure and Weakening of the protection of victims - Conclusion
