영문 초록

The volume of trade between India and Korea has been sharply increased with the increase of dispute since 2000. Dispute plays a key role in maintaining the desirable performance of trade transaction. So, if disputants agree on a specific arbitral institution, they can settle their disputes by arbitration easily and quickly. As success and failure of arbitration depend on arbitration institute's rules, the understanding of main contents between KCAB's International Arbitration Rules and ICA' Arbitration Rules is a necessary requirement for successful dispute resolution between Korean and Indian companies. This article analyzed and compared with the arbitration agreement, arbitrator(s) and arbitral award between two arbitration institute's rules in order to help the Korean traders who enter into business with the Indian companies to settle their disputes efficiently.
