우리나라 범죄피해자보상제도에 관한 연구

국문 초록

그동안 범죄를 가해자 내지 범죄자 입장에서만 파악하고 피해자의 인권이나 보상적인 측면은 외면시 되어 왔는데, 제2차 세계대전 이후 범죄피해자보상이 사회보장제도로 도입되어야 한다는 주장이 제기되면서 피해자에 대한 관심이 집중되었고, 이후 유럽 등 각국에서 범죄피해자보상제도 관련법을 입법화하기 시작하였다. 우리나라는 1987년 헌법 개정으로 법적 근거를 마련하였고 1987년 범죄피해자 구조법을 제정하였다. 이후 범죄피해자구조법은 2005년 제정된 범죄피해자보호법과 같이 시행되다가 2010년 5윌 폐지되고 전부개정된 범죄피해자보호법에 통합되었다. 현재 범죄피해자보상제도의 법적 근거가 되는 범죄피해자보호법은 몇 차례의 개정을 통하여 시행 초기에 비하면 그 요건이나 금액 등에 있어서 많이 발전된 것은 사실이다. 그러나 범죄건수에 비하여 구조금 지급 건수가 1%도 되지 않아 다음과 같은 개선 방안 마련이 시급하다. 첫째, 범죄피해의 개념을 보다 확대하여 피해자 가족과 피해자의 장기적 피해에 대한 지원을 고려해야 한다. 둘째, 범죄피해자 보상제도 관련 정보를 널리 알릴 수 있는 방안이 필요하다. 셋째, 구조금 지급의 범위를 보다 확대시켜야 한다. 넷째, 구조금액을 범죄피해자에게 실질적인 도움이 될 수 있도록 현실화해야 한다. 다섯째, 보다 다양한 지원책이 마련되어야 한다. 여섯째, 해외에서의 범죄피해에 대한 보상책이 마련되어야 한다.

영문 초록

In the past, criminal law was thought about attacker or criminal, it didn’t concern criminal victim’s human right or guarantees. After World War Ⅱ, many people insist that Criminal Victim Compensation Program should be introduced the social security system. So many country such as Europe started to legalize law that is related on Criminal Victim Compensation Program. In 1987, Korea established a legal basis as a constitutional amendment enacted the Crime Victims Aid Act. In 2005, the Crime Victims Aid Act was enacted and abolished in May 2010. Finally it was incorporated into all revised the Victims of Crime Act. Through the revisions this is the fact that the current Criminal Victim Protection Act that is legal basis for Victims of Crime Compensation Act is advanced compared to the initial implementation requirements and the amount. However, it is also inadequate, we need to improve the followings because the number of compensation don’t reach even 1% compared to the number of crimes. First, through the expansion of the concept of crime victims, support for the long-term damage of victims’ families should be considered. Second, the measures to spread the information about the Criminal Victim Compensation Program should be publicized. Third, compensation should widen the scope. Fourth, compensation should become a practical help to crime victims. Fifth, the more diverse support measures should be provided. Sixth, the compensation for criminal victim in another country should be made.
