9 · 11이 국제법질서에 미친 변화

국문 초록

알카에다라는 비국가행위자에 의해 자행된 9·11은 21세기 초 국제관계와 현대국제법 질서에 큰 영향을 미쳤다. 특히 9·11 이후 아프가니스탄과 이라크에 대한 무력공격은 무력행사 관련 법규와 개인의 법적지위 등에 많은 변화를 가져왔다. 일 국가에 의한 선제적군사행동론, 누적적 행위이론, 테러집단에 대한자위권 행사 가능성은 무력공격의 범위를 확대시킬 수 있음을 보여 주었고, 그 결과 유엔 안전보장이사회의 무력행사를 통제하는 권위가 상당 부분 실추되었다. 그러나 연구를 행한 공동저자들은 9·11 이후 무력사용법에 전면적인 변화가 생긴 것은 아니며, 유엔을 통한 무력사용의 통제는 계속 존속하며, 개별 국가에 의한 자위권 행사는 여전히 예외적인 것으로 남아있다는 결론에 도달하였다. 한편 이른바 ‘테러와의 전쟁’으로 인하여 체포 또는 감금된 테러리스트와 분쟁지역에 투입되어 활동하는 ‘민간군사기업’의 법적 지위가 새로이 조명을 받게 되었고, 그들에의 국제법 특히 국제인도법 및 국제인권법 적용 논의가 제기되면서 개인의 법적 지위가 재정립되어야 하는 것은 아닌지에 대한 의문도 제기되었다. 그러나 연구결과, 테러리스트와 민간군사기업 같은 국제법상 개인, 특히 국제법의 수범자로서의 지위가 강화되었을 뿐 수동적 주체로서의 개인의 법적 지 위에 획기적인 변화가 나타난 것은 아니라고 판단된다. 이러한 결론을 종합해볼때 9·11은 무력사용법이나 국제인권법, 국제인도법의 세부 영역에 있어서 새로운 변화를 가져온 것은 사실이지만, 국제법 근간에 획기적인 변화를 야기한 것은 아니라고 결론 지울 수 있다.

영문 초록

To what extents the September 11 attacks done by Al Qaeda terrorists, i.e., ‘non-State actors’ have influenced to international relations and international law at the beginning of the 21^st century? This article considers especially challenges against traditional legal doctrines in the field of the use of force and the legal status of the individuals in international law. It seems that so called preemptive military action doctrine, accumulation of events theory and the self-defense against the terrorist group expand scope of self-defense. Moreover, the authority of the Security Council, as a major international security institution which can regulates an eventual use of force, seems to have been severely damaged after 9·11 by unilateral military actions done by certain States. However this research came to a conclusion that the existing norms concerning use of force is not affected overall changes because the primary role of the Security Council in the field of international security is well functioning and also self-defense regime cannot be affected by unilateral claims. After the outbreak of ‘war against/on terror’, there were questions whether the legal status of individuals in international level would be changed considering the lively debates regard to the application of the international human right law and international humanitarian law to the terrorist and PMCs(Private Military Companies). Although the legal status of individuals such as terrorist and PMCs has attracted public attention, it has not been a change of their status as subject of international law but it has enhanced their status as objects complying to international law. Our overall conclusions are first, the 9·11 indeed brought some changes in the field of the law of use of force, international human right law, international humanitarian law and other international legal frameworks. However, secondly, the force of change was not strong enough to change the fundamental and essential structure of modern existing international law.
