메스암페타민사범의 양형에 있어서 법적 요소와 법외적 요소의 영향

국문 초록

본 연구는 메스암페타민 사범들을 대상으로 양형의 편차에 영향을 미치는 법적 요인과 법 외적 요인들을 경험적으로 규명하고, 양형의 불균형에 관한 기존의 두 시각 - 형식합리성 대 실질합리성 - 이 갖는 유효성에 관해 논한다. 본 논문을 위한 자료의 출처는 한국형사정책연구원이 2002년도에 수행한 「마약류 사범 처리 실태」 조사이다. 본 논문은 상기 조사를 통해 수집된 사례들 중 가장 대표적인 향정신성의약품인 메스암페타민 관련 사범 1,297명을 분석한 것이다. 분석결과, 메스암페타민 사범에 대한 양형의 경우, 법적 변수들의 설명력이 법 외적 변수들에 비해 훨씬 큰 것으로 나타났다. 구체적으로, 법적 변수들 중에서는 공범의 수, 범행유형, 범행의 계속성, 그리고 누범전과의 정적 효과가 유의미하였고, 법 외적 변수들 중에서는 범행을 부인하는 정도와 성별(남성)의 정적 효과만이 유의미하였다. 이러한 연구결과는 결론적으로, 메스암페타민 사범에 대한 우리나라 사법당국의 양형실무관행이 실질합리성 시각보다는 형식합리성 시각으로 더 잘 설명될 수 있다는 것을 의미한다.

영문 초록

This study addresses the effects of legal and extra-legal factors on sentencing disparity among S. Korean methamphetamine offenders and evaluates the efficacy of the two major theoretical perspectives - the formal rationality versus substantive rationality - explaining the sentencing disparity. The data come from ｢The Realities of Legal Disposal against Drug Criminals｣(2002) by the Korean Institute of Criminology. This study is based on the analysis of 1,297 methamphetamine offenders. The result of analysis indicates, in terms of the coefficient of determination, the legal factors are much stronger than extra-legal factors in explaining sentencing disparity among methamphetamine offenders. More specifically, among legal factors, the positive effects of Number of accomplice, Type of drug crime, Continuity of crime, and History of repeated offenses were significant, while, among extra-legal factors, the positive effects of Denial of charge and Gender (Male) were significant. Therefore, this study concludes the formal rationality perspective is more effective in explaining the sentencing decision making practices of the Korean justice system, than the substantive rationality perspective.
