국문 초록

본 연구는 장애인의 교육권의 정당성과 위험요인을 살펴보고 그에 대한 개선방안을 제언하기 위함이었으며, 내용을 간단히 요약하면 다음과 같다. 첫째, 장애인의 교육은 누구나 평등하게 교육을 받을 권리에서 출발해야 한다. 장애인은 누구나 언제, 어디서나 교육받을 권리가 있고, 그 권리를 법적으로 보장한 것을 의미한다. 둘째, 장애인의 교육권을 보장하기 위해서는 법을 이행하는 것이 중요하다. 법은 법으로서 끝이 아니라 교육권을 보장하기 위한 시작이 되어야 한다. 교육기관 또는 정부에서 해결해야 할 과제는 이동 및 접근에 필요한 편의시설과 교수-학습에 필요한 인적․물적․제도적 지원, 직업교육, 평생교육, 평가방법 개선, 실제적 개별화교육 운영, 제한적 환경의 최소화, 장애인 특별전형제도 개선과 교육지원, 부모참여 등이 요구되고 있다. 셋째, 장애인 교육에 대해 국가차원에서 각종 제도적, 실제적인 재정지원이 적극적으로 이루어져야 한다. 현 시점까지의 지원체계 구축 수준이 학교가 자체적으로 수행할 수 있는 능력이 한계라는 점을 인식하고, 국가차원의 재정 확보와 지원만이 장애인 교육 기회확대를 위한 편의시설 확보와 교사․학습지원 시스템 활성화가 가능할 수 있다. 넷째, 장애대학생들의 교육권 보장을 위해서는 정부와 대학에서는 장애인 대학입학 특별전형 제도 개선과 교육환경 예산 지원이 이루어져야 한다.

영문 초록

This study had the purpose to research the legitimacy of the disabled education right and relevant danger factors, and to suggest improvements. The brief summary is as follows. First, the disabled education must start from the right whoever can be taught equally. It means that the disabled has his/her education right anytime and anywhere, and the right must be guaranteed by law. Second, for guaranteeing the disabled education right, it is important to implement the law. The law must not be the end as the law, but the start to guarantee the disabled education right. Educational institutions or central/local government is required to solve many tasks including the expansion of convenient facilities necessary for movement and access, the support of human, material and system necessary for teaching & learning, the improvement of vocational, lifelong educations and their evaluation methods, the practical operation of individualized education, the minimization of limited environments, the improvements for the disabled special admission system, the education support, and the parents' more active participation. Third, various institutionally, practically financial support for the disabled education must be more activated at the national level. The nation must recognize that relevant support system constructed by this time is limited to the level for each school's own performance, and understand that the national funding and support only enables to secure some convenience facilities for expanding the disabled education opportunity, and to activate the teacher & learning support system. Fourth, to guarantee the disabled students' education right, the government and each university must improve the special admission system for the handicapped, and set the budget for education environment
