국문 초록

이 논문에서는 중국에서 발원하여 한국, 일본으로 지나는 황사 문제를 대상으로 초국경(transborder) 환경피해에 대한 분쟁 해결에 대해 살펴보고자 한다. 중국과 한국을 각각 황사 발생국, 피해국으로 상정한 코즈(Coase) 모형을 구축한 다음, 국제 환경 분쟁을 분석하기 위해서는 전통적 코즈 정리가 재산권이 불확실한 경우로 확대되어야 함을 보여준다. 불완전 재산권 구조에서 당사국들은 초국가적 재산권 신설보다, 이른바 ‘법 없는 질서(order without law)’ 즉 분권적 협상을 통한 고유한 협력방식을 모색하는 경우가 많다. 황사 분쟁의 경우에도 동북아가 처한 고유한 지정학적인 요소와 황사의 기후환경적 요소들은 황사 협상의 고유한 거래비용을 결정하게 된다. 그 결과 다른 지역의 환경문제 (가령 유럽의 산성비, 동남아의 연무)와 비교하여, 동북아의 황사 협력에서는 당사국들의 투자와 몰입이 상대적으로 낮은 것으로 나타나는데, 이는 당사국들의 거래비용을 절감하기 위한 불가피한 선택으로 보인다.

영문 초록

In this paper, we construct a Coase Theorem example with China and Korea as injurer and victim respectively, and show that the traditional Coase theorem is no more useful in dealing with the so-called transboundary pollutions which move across national borders. A new source of transaction costs comes from the absence or incompleteness of property rights in transboundary pollution. This especially makes state-to-state bargaining much more costly than domestic bargaining. In particular, in case of yellow sand storms in the Northeast Asia, nations opt to choose a more decentralized, less committed form of cooperation, compared to other regional transboundary pollution cases. We show that transaction costs in yellow sand storm negotiations are particularly region-specific and idiosyncratic and that state parties in Northeast region prefer more de-centralized, more horizontal and less committed form of resolution of the Dust and Sandstorms (DSS) than those in ASEAN and European regions. We also argue that the modality of cooperation in control of dust and sandstorms is an outcome of economizing these transaction costs.
