국문 초록

인권에 관한 인식은 l. 2차 대전을 겪은 인류의 각성과 유엔 창설， ‘세계인권선언’ 선포등으로 크게 향상 되었다 그러나 냉전시기 0945-1991)의 동? 서 대립의 영향과， 인권을 둘러싼 논쟁 등으로 인해서 인권보호에는 한계를 나타내고 있다. 논쟁의 주 쟁점은 ①인권의‘보편성 주장 대 문화상대성 주장’ @ ‘시민적?정치적 권리(자유권 B규약) 중시 대 경제적.사회문화적 권리 (사회권 A규약) 중시’ @ ‘외부 간섭 가능 주장 대 국가주권간섭 불가주장’ @ ‘인류공유 사상론 대 서유럽중심 사상론. 등이라 할 수 있다 각 쟁점의 후자 즉문회삼대성 주장. 사회권 (A규약) 중시 . 국가주권론. 서유럽 중심 사상론 등은 대개 사회주의 국가와, 개발도상국 특히 인권이 열악한 나라들의 주장이다. 그러나 시간이 흐름에 따라 그들 주장의 정당성은 약해지고 있다 그 이유는 국경을 초월하는 인권 활동이 강화되어왔기 때문이다(머리말 후반 참조) 유럽연합 (EU-27개국)은 북한의 인권개선을 위 해 두 가지 방략 즉 북한과의 직접 ‘인권대화’방식과 유엔을 통한 간접방식으로 국제사회에서 선도적 역할을 해왔다， 그 노력은 파급되었고 유엔은 북한인권특별보고관 임명 . 인권위원회의 이사회 격상‘ 회원국 인권을 점검하는 ‘보편적 정례검토(UPR) 제도의 실시 등 인권활동을 강화 하고 있다 2003년 이래 유엔의 각급 회의는 EU주도로 상정된 ‘북한인권결의안’ 을 도합 12번 채택 했다. 그러나 북한은 ‘내정간섭’ 등을 이유로 거부하고 있다 그러면서도 헌법 등에 새로 인권 조항을 삽입하고， 유엔 인권 레짐에 계속 참여하는 등 국제사회를 의식하는 양면성을 보이고 있다 따라서 북한이 국제 규범과 결정을 거부할 수 없도록 유도할 필요가 있다. 동시에 국제 인권 레짐과 북한당국과의 상호작용이 .구성주의 에서 주장하는 두 가지 규범효과 즉 ‘규제효과(regulative effect)’ 와 ‘구성적 효과(constitutive effect)’ 를 발생시키도록 해야 할 것이다. 이 논문은 EU 및 유엔의 인권활동 강화 추세와 대 북한 인권개선 노력 ， 그에 대한 북한의 대응 등을 살펴보고 유엔 인권 레짐의 강화， ‘국가책임론 제기 등 북한 인권개선 방안을 모색 하고자 한 것이다.

영문 초록

Even in post-cold war era and ín 21st century， infringement of human rights occur throughout the world, particularly under the despots. North Korea is one of the worst nations in terms of human rights situations. EU has been devoted efforts to improve North Korean human rights since end of 1990s, with using two different tactics. The one is .direct dialogues on human rights' between EU countries and the North Korean govemment which have drawn out occasionally but no significant results as the latter' s unwillingness. The other tactic was implemented through the activities in the UN human rights regimes. EU' s such effOlts influenced international societies and UN strengthened it’s human rights regimes. UN Human Rights regime reinforced 따functions and activities as of nominating the ‘Special Rapporteur on the situation of human rights ín the DPR (north) Korea’in 2004, upgrading the UN Committee on Human Rights to Human Rights Council and Creating of ‘Universal Periodic Review (UPR)" system in 2006 of which all member states ought to have review its own human rights conditions every four year by other member states. UPR rnight be one of the system transcend the national border and it’s sovereignty in UN debates. EU had been raised the agenda of total 12 Draft Resolutions on the North Korean human rights situation and let them passed since 2003. Nevertheless North Korea tum down the UN resolutions saying that those resolutions are ‘intervention to the own sovereignty, internal affairs’. However there are yet no measures to restrain North Korean tum down the UN Resolutions and other recommendations of international society. Meanwhile North Korea amended the constitution and criminal law recently including human rights clauses and continually attend in the UPR process .. These North Korean intentional dual attitude might be result of their consciousness of the international societies' activities. It is desirable method to get more strengthen the UN Human Rights Regime and UN Security Council to make North Korea couldn’t refuse the UN resolutions. This treatise is trying to find available measures in UN and other international societies for improving North Korean human rights situations.
