조국교수의 사형 폐지론에 대한 천정환의 반론 및 사형수에 대한 교정복지론

국문 초록

  2008년 5윌 30얼 국회에서 국회법사위원회 주최로 “사형제에 관한 토론회”가 열렸는데 이 자리에서 조국교수(서울대)는 “사형폐지를 위한 단계적 실천방안”을 주장했으며 필자가 이에 대해 토론 반론을 제기한적이 있는데 이 논문은 그 당시에 있었던 토론의 일부 내용을 보완한 뒤 새로운 내용으로 첨가하여 대폭 확대하여 전개한 논문이다.
  사형존폐론은 인류역사만큼이나 오래된 논쟁의 산물이지만 사형폐지론자들의 주장에 나타난 오류, 특히 조국교수의 사형폐지론에 내재된 논리적, 내용적 오류들을 명확히 파헤침으로써 보다 성숙된 사형존폐론을 이끌어 내자는 것이 이 논문의 목적이다. 이 논문에서는 조국교수가 주장한 내용을 소개한 뒤에 그의 논문에 나타난 여러 오류들을 사견으로 파헤친 뒤에 사형존폐론과 연장선상에 있는 사형수에 대한 교정복지의 필요성을 운론하였다.

영문 초록

  For the first time, many countries in the world have abolished the death penalty (the penalty for prisoner"s under sentence of death)
  Especially, the international human rights instruments including UN have recommended countries where there is a moratorium an executions of death penalty (for example, korea) and a existing death sentences the abolition of the death penalty system.
  But korea penal system have now maintained the death penalty system in spite of the recommendation of the international covenants and other human rights instrument (for example, UN, Amnesty)
  But in korea society, the exiting or abolition debate of the death penalty system have continued for a long time and now under way : Thus The human welfare society of korea and The national assembly together opened a debating society for the exiting or abolition of the death penal system of korea in the national assembly. A few debaters including Chun Jung Hwan(The correctional welfare society of korea) and Cho-Kuk (The national seoul university) participated in the discussion of exiting or abolition issues for the death penal system in korea.
  In the national assembly debate society, we cannot conclude which one is right. But The purpose of chun Jung Hwan"s study is to clear assuredly wrong aspects of the death penal abolition theory of Cho-Kuk professor/the national seoul university), such as prevention force of the death penal system in korea. interpretation on data introduced by Cho-Kuk professor, acceptance of the international covenants and other human rights instrument which is used by Cho-Kuk professor, and other factors would be effected on the heavy crime in relation to death penal, and in this study I asserted that The social welfare of prisoners under sentence of death, such as sex rights, cigarette rights, the labor rights of correctional prison, and so on will be accepted assuredly by ministry of justice and the leading opinion which will be able to affect death penalty politics in korea.
