국문 초록

본 연구의 목적은 「스포츠기본법」을 젠더 관점에서 고찰한 후 문제점을 발견하고 이를 토대로 개정방안을 제안하는 것이다 「스포츠기본법」은 스포츠 분야를 총괄하면서 업무영역을 종합적·체계적으로 규율할 수 있는 유일한 스포츠 대표법이다. 통상의 법률규정에 비해 우월적 지위에 있다고 볼 수 있기 때문에 이 법 자체가 갖는 존재감은 상당하다. 『스포츠기본법」의 법적성격은 기본적 이념을 전달하는 ‘헌장의 형식’ 보다는 전체적으로 스포츠 정책의 근거가 되는 ‘스포츠정책기본법의 성격에 더 가깝다고 볼 수 있다. 따라서 스포츠정책들은「스포츠기본법」에 근거하여 설립·이행되기 때문에 이 법이 지니는 파급효과를 충분히 고려하여야 한다. 이러한 영향력을 고려해서 본 연구는「스포츠기본법」을 젠더 관점에서 고찰하였다. 지난 수십년간 우리는 스포츠 현장에서 젠더 문제를 눈으로 목격해 왔고, 이를 제거하기 위해 치열하게 싸워왔다. 그러나 선수 및 지도자의 성비 불균형, 여성(선수)지도자의 고용 및 노동에서 불평등, 여성(선수)지도자의 출산 및 육아에 의한 경력단절과 같은 젠더 문제는 여전히 해결되지 않고 있다. 이제「스포츠기본법」이 제정되었으니, 이 법에 젠더 문제를 해결할 수 있는 근거조항들이 포함되길 기대한다. 결론적으로 다음 7가지 내용의 개정방안을 제안하였다: 스포츠소외계층에 대한 정의, 국민의 권리, 국가와 지방자치단체의 책무, 스포츠정책수립·시행의 기본원칙, 스포츠 진홍 기본계획의 수립, 국가스포츠정책위원회 구성, 그리고 스포츠 진흥을 위한 조사· 연구와 개발에 관한 내용.

영문 초록

The purpose of this study is to propose amendment of the 「Basic Law on Sport」 by examining and discovering problems in terms of gender perspectives. The 「Basic Law on Sport」 is the only sport representative law that can comprehensively and systematically regulate the field of work while overseeing the sport field. Since it can be considered to be in a superior position compared to ordinmy legal regulation, the presence of this law itself is considerable. The legal nature of the 「Basic Law on Sport」 can be seen as closer to the nature of the 'Basic Law on Sport Policy', which is the basis of sport policy as a whole, rather than the 'form of charter' that conveys the basic ideology. Therefore, since sport policies are established based on the 「Basic Law on Sport」 , the ripple effects of this law should be fully considered. Considering this influence, this study examined the 「Basic Law on Sport」 from a gender perspectives. Over the past few decades, we have witnessed gender issues in sport, and we have fought fiercely to elinlinate them. However, gender issues such as imbalance of gender ratio between 뻐etes and coaches, inequality in employment and labor of female players/coaches, and career interruption due to childbirth and childcare of female players/coaches remain unresolved. Now that the 「Basic Law on Sport」 has been enacted, we hope that the law will include grounds for solving gender problems. In conclusion, the following seven amendment were proposed: the definition of the sport underprivileged, the rights of the people, the responsibilities of the State and local governments, the basic principles of sport policy establishment and implementation, the establishment of a basic plan for sport promotion, the composition of the National Sport Policy Committee, and the investigation, research, and development for sport promotion.
