신병훈련소 훈련병 인권상황 개선방안 연구

국문 초록

자유롭고 풍요로운 환경에서 성장한 MZ세대들이 다소 딱딱하고 억압적인 신병훈련소에 입소하면모든 것이 어색하고 불편한 가운데 사회로부터의 고립감과 단절감으로 인해 심리적 불안정 상태에놓일 수 있다. 그리고 훈련병들은 징병제로 인해 의무적으로 입대하였으므로 군복무에 대한 의욕도크게 높지 않은 상태이다. 반면에 교관과 조교 등 신병훈련소 운영요원들은 민간인을 군인으로 탈바꿈시킨다는 사명감이 있으므로 훈련병들을 강하게 훈련시키고자 한다. 따라서 서로 상반된 입장으로인해 신병훈련소에서 훈련병들에 대한 인권침해가 발생할 개연성은 매우 높다고 예상할 수 있다. 각 군에서 운영하는 신병훈련소 훈련병들의 인권상황을 파악하기 위해 설문조사를 실시한 결과, 구타 가혹행위 등 직접적인 인권침해 행위가 발생하는 사례는 많지 않았으나, 자유권과 행복추구권 부분에서는 개선해야 할 사항이 많은 것으로 나타났다. 공통적으로 생활시설(생활관, 식당, 화장실)이 대부분 노후화되었으며, 급식의 질이 높지 않은 가운데 급식량도 부족하고, 군대 외부와소통하거나 정보교류에 필요한 TV시청·공중전화 사용·핸드폰 사용 등도 통제받고 있었다. TV 시청과 영내 군매점 사용 같은 경우에는 각 군별 또는 부대별로 기준이 달라서 훈련병들 간에도차별이 이뤄지고 있으므로 해소방안이 필요한 것으로 나타났다. 군대 의료인력들은 매우 불친절하고 전문성이 부족하다고 인식되고 있었다. 훈련병과 훈련소 운영요원들에 대한 인권교육은 전문성이 부족한 것으로 나타났으며, 상담관과 의료기관 종사자들에 대한 인권교육도 미흡한 것으로 나타났다. 훈련병들이 인권침해를 당했을 때 구제를 받을 수 있는 제도/기관/기구에 대한 인식도는비교적 낮은 실태인 반면에, 소원수리와 마음의 편지 제도에 대해서는 훈련소 운영요원들로부터제도개선 요구가 매우 높게 제기되었다. 각 군에서 운영하는 신병훈련소에서 훈련병들의 인권상황을 개선하기 위해서는 훈련병도 보편적인 국민의 한 사람이라는 인식을 국방정책 수립자들이 가져야 할 것이다.

영문 초록

If the MZ generation, who grew up in a free and affluent environment, enters a rather hard and oppressive recruit training center, everything can be awkward and uncomfortable, and psychological instability can be caused by isolation and disconnection from society. In addition, since the trainees were compulsory to enlist due to the conscription system, the motivation for military service is not very high. On the other hand, recruit training center operators, such as instructors and assistants, have a sense of mission to transform civilians into soldiers, so they want to train their trainees strongly. Therefore, it can be expected that it is highly likely that human rights violations against trainees in boot camps will occur due to conflicting positions. As a result of a survey to understand the human rights situation of recruit training center trainees operated by each county, there were not many cases of direct human rights violations such as beating and abuse, but there were many things to improve in the right to freedom and happiness. In common, most of the living facilities (living rooms, restaurants, and toilets) were aging, and the amount of meals was insufficient while the quality of meals was not high, and TV viewing, public phone use, and cell phone use were also controlled. In the case of watching TV and using military stores in the compound, the standards are different for each county or unit, so there is discrimination among trainees, so a solution is needed. Military medical personnel were perceived to be very unfriendly and lacking in expertise. Human rights education for training soldiers and training center operators was found to be lacking in expertise, and human rights education for counselors and medical institution workers was also found to be insufficient. While the awareness of the system/institution/institution that trainees can receive relief when they are violated is relatively low, the training center operators have raised a very high demand for system improvement for wish repair and heart letter system. In order to improve the human rights situation of trainees at recruit training centers operated by each military, defense policy makers should have the perception that trainees are also one of the universal people.
