대면편취형 보이스피싱 범죄 대응방안

국문 초록

대면편취형 보이스피싱 범죄가 최근 급증하고 있다. 정부 당국이 계좌이체 등을 이용한 보이스피싱범죄에 대해서 대대적으로 단속과 예방과 홍보활동을 벌인 결과 보이스피싱 범죄가 최근 감소하는추세였으나, 당국의 대응을 회피하기 위해 기존의 범죄가 진화한 유형이다. 이에 대한 대응방안으로금융기관 창구 예금인출 시 일정금액 이상은 수표발행을 통한 현금인출 제한 제도의 도입, 대면편취형보이스피싱을 전기통신금융사기에 포함시키는 전기통신 금융사기 피해방지 및 피해금 환급에 관한특별법 개정, 보이스피싱 피해방지 시스템 구축, 112 피해 신고 접수 개선, 고의적인 자금수거책에대한 처벌 강화와 신상공개제 도입, 범죄에 사용된 전화번호와 메신저 계정의 영구정지를 위한 법적근거 마련, 대면편취형 보이스피싱 범죄 피해자 구제 강화, 구인·구직 광고에 대한 정부 차원의 모니터링 강화와 관련 사이트 운영자의 관리 의무 강화, 진화하는 보이스피싱 범죄에 맞춤형 예방교육과홍보, 개인정보 관리 강화, 현금인출기 주변 CCTV 모니터링 강화, 경찰청의 보이스피싱 범죄 대응T/F 설치와 전담부서 운영을 지구대와 파출소로까지 확장 운영을 제안하였다. 예금인출 시 일정금액이상은 수표 발행 의무화를 통한 현금인출 제한 제도가 도입된다면 보이스피싱 피해자가 다액의 현금을인출하여 대면편취형 보이스피싱의 현금수거책에게 전달하는 위험성이 상당 부분 해소될 수 있을것으로 보인다. 지능적으로 변모하는 보이스피싱 범죄의 특징을 반영한 대응방안을 제시하여 보이스피싱 범죄가 시도될 수 없는 환경을 만드는데 연구의 초점을 두었다.

영문 초록

The number of face-to-face voice phishing crimes using money collection measures has soared recently. Despite the government s extensive crackdown, attempts at prevention, and public relations activities on voice phishing crimes using account transfers, existing crimes have evolved to avoid the authorities response. Countermeasures include the following: First, the introduction of a cash withdrawal restriction system through the issuance of a check for more than a certain amount when withdrawing deposits at a financial institution s window. Second, the revision of the Special Act on the Prevention of Telecommunications Financial Fraud and the refund of damaged money including Face-to-Face Voice Phishing. Third, the establishment of voice phishing damage prevention system, 112 Improved receipt of damage reports, strengthening penalties for deliberate fund collection and the introduction of a personal disclosure system. Fourth, the establishment of legal grounds for permanent suspension of telephone numbers and messenger accounts used in crime, strengthened monitoring at the government level of job openings and strengthened management obligations of relevant site operators. Fifth preventive training and promotion tailored to evolving voice phishing crimes, the strengthening of personal information management and CCTV monitoring around ATMs. Finally, the national Police Agency s establishment of a voice phishing crime response T/F, and the operation of dedicated departments extended to police stations were presented. The research focused on creating an environment in which voice phishing crimes cannot be attempted by presenting countermeasures that reflect the characteristics of changing voice phishing crimes.
