스포츠단체의 법적 규율방안

국문 초록

스포츠는 현대사회에서 영향력이 큰 분야로 성장하고 있다. 특히 스포츠산업이 스포츠경기의 세계화에 힘입어 발전하면서, 스포츠는 21세기 중요한 분야로 각광받고 있다. 스포츠의 발전과 영향력의 확대 및 경제적 가치의 증대는 스포츠분야에 대한 국가의 개입과 관여를 요구하게 되었다. 물론 그렇다고 하여도 스포츠영역에서 전통적으로 유지되어 오던 스포츠자치권이 부정되는 것은 아니다. 그렇기 때문에 스포츠단체들이 자신의 종목에서 제정한 자치규칙들은 국가법질서와 관계없이 그대로 효력을 갖는다. 스포츠단체들이 제정한 경기규칙이나 조직에 관한 규칙들은 스포츠자치권의 영역에서 인정되고, 국가로부터 보장된다. 그렇지만 스포츠의 영향력이 우리 사회에 미치고 잇는 실정에서 국가는 스포츠단체의 자치권을 인정한다고 하여도, 국가법질서와 충돌되거나 갈등관계에 있는 경우 이에 대하여 규율할 수밖에 없다. 스포츠단체의 결성은 그 단체가 자발적이고 외국으로부터 유입된 것이든 이에 불문하고, 헌법에 의하여 보장받는다. 헌법상 결사의 자유는 스포츠단체를 결성하고 운영하는데 있어서 근간이 되는 국민의 기본권이다. 스포츠단체는 이런 헌법적 근거를 갖고 결성되었고, 통상적으로 법인의 형태로 활동하게 된다. 우리나라에는 현재 스포츠 각 종목별로 상당수의 단체가 대한체육회에 가입되어 있다. 국가는 이들 단체에 대하여 스포츠의 육성과 발전을 위하여 재정보조 등 여러 면에서 지원을 하고 있다. 스포츠단체의 결성과 활동에 관하여 스포츠자치 영역에서 자율을 우선하고 있지만, 스포츠가 국민에게 미치는 영향이나 그 경제성을 볼 때 국가의 입장에서는 이를 보호하면서 규율해야 할 책무가 있다. 스포츠단체와 관련해서 현재 우리나라 실정법은 기본적이 내용만 갖고 있다. 우리나라 스포츠법의 대표법이라 할 수 있는 국민체육진흥법에는 스포츠단체와 관련하여 몇 규정들이 있지만, 현실적으로 내용이 부족하다. 물론 스포츠단체에 대하여 스포츠가 갖는 특수성을 인정하고 사적 자치를 허용해야 하지만, 스포츠단체 역시 그 공적 기능을 갖고 있기 때문에 일정한 범위 내에서 국가의 법적 규율을 받아야 한다. 아무튼 현행 스포츠단체의 관련 규정들은 시대에 뒤떨어지는 내용들을 담고 있는 것은 사실이다. 이렇게 규정의 미비나 흠결로 인하여 스포츠의 자율성이 저해되고 스포츠계가 가지고 있는 고질적인 병폐들이 개선되지 않는 문제들이 발생하고 있다. 따라서 21세기의 패러다임에 맞는 스포츠단체의 선진화를 위한 관련 규정들의 개선이 시급하다.

영문 초록

Sports is growing in the modern society as an influential domain. Especially as sports industry developed with the globalization of sports games, sports is regarded very important in the 21th century. The development of sports and its increase of influence and economic value came to require the intervention of state. Of course, this does not mean that the traditionally maintained autonomy of sports is being denied, which is why in principle the autonomous rules of sports organizations within their area still have an effect regardless of state legal order. The rule of games and rules on organizations by sports organizations are admitted in the domain of sports autonomy and guaranteed by the state. However, considering the increasing influence of sports on our society, state has no choice but to regulate the rules despite their autonomy, if the rules collide with the state legal order or are in contratiction with it. The establishment of sports organizations is guaranteed by the constitution, regardless of the organization being from a foreign country or not. The freedom of assembly guaranteed in the constitution is a basic right which consists the ground of the establishment and operation of sports organization. The state places the autonomy of sports on priority regarding the establishment and activity of sports organizations, but it has a duty to protect and regulate the domain as well considering the influence and the economic value of sports. Regarding sports organizations, our current positive law has only basic contents. The representative National Sports Enhancement Law has some regulations, but they are not enough. Of course, the specific character of sports should be admitted and its autonomy should be allowed, but since sports organizations have public functions as well, they should be regulated by the state to a certain extent. Anyway, it is true that the current sports organization regulations are behind the development of society. Due to the lack of reguation, the autonomy of sports is not guaranteed enough and the typical problems of sports organizations are not being improved. Therefore, establishment and revision of related regulations aiming the development of sports organization conforming to the 21th century is in an urgent need.
