기초자치단체의 고독사 예방 조례 분석

국문 초록

본 연구는 서울특별시 자치구의 고독사 예방 조례의 내용을 분석하여 각 조례의 특징과 문제점을 밝히며 이를 토대로 보다 실효성 있는 고독사 예방을 위한 조례 개선방안을 모색하는데 목적이 있다. 이를 위하여 고독사의 개념, 권리성, 대상자, 급여, 재정, 전달체계에 근거한 분석기준을 사용하여 서울특별시 자치구의 고독사 예방 조례 20건을 분석하였다. 분석결과, 서울시 자치구의 고독사 예방 조례는 내용 면에서 유사하여 지역 특성이 반영된 차별성은 거의 없었다. 대상범위를 장년층으로 확대한 3건의 조례를 제외한 17건의 조례는 홀로 사는 노인만을 대상으로 하고 있어 고독사 위험군인 장년층 1인가구가 배제된 한계가 있으며, 고독사 위험자의 욕구에 부합한 급여가 다양하게 규정되지 못하였다. 또한 모든 자치구의 조례는 예산과 관련하여 임의규정이 많고, 권리성도 낮은 수준으로 나타나는 등 고독사 예방의 실효성을 높이기에는 내용이 미흡한 것으로 나타났다. 이러한 분석을 기초로 향후 기초자치단체에서 지속적으로 제정, 개정하게 될 조례의 발전방향을 제시하였다.

영문 초록

The purpose of this study is to identify the characteristics, problems and to find ways to improve of the local ordinance for the prevention of solitary death, especially the local ordinance of autonomous district of Seoul. For this purpose, we analyzed the contents of 20 cases of the solitary death prevention ordinance of the Seoul Metropolitan Government autonomous districts by using analysis criteria based on concept of the solitary death, frame of rights, allocation, provision, finance, delivery system. As a result of the study, there were few differences in the characteristics of the region. The 17 ordinances were almost similar in contents, with the exception of three cases in which the target range was set as a middle-aged. However, the ordinances of all the autonomous regions were found to be insufficient in terms of contents. There were many voluntary law on the budget and the right personality was weak. Based on this analysis, the authors suggest the development of the ordinance which will be continuously enacted and revised by the basic autonomous districts in the future.
