국문 초록

인류는 근대 이후 국민국가와 제국주의 시대와 폭력의 세기를 거쳐 지구화 시대에 이르는 과정을 경험하고 있다. 누구든 한 국가에 사는 시민이지만, 지구를 고향으로 생각하며 공존을 모색해야 인류의 한 구성원이다. 그러기에 우리는 인간다운 삶을 가능케 하는 정치와 법의 중요성을 고려하지 않을 수 없다. 즉 정치와 연관된 법은 정치적 실재인 자유를 보호하는 울타리이다. 우리는 최근 등장하는 다양한 유형의 지구적 비상사태로 정치 행위로서 연대와 협력뿐만 아니라 정치와 정치적인 것을 보장하는 제도로서 법에 관심을 가져야 한다. 인류의 연대는 정치적 책임을 동반할 때만 적극적 의미를 지닌다. 이런 문제의식의 해답을 찾고자 법과 정치의 관계를 천착한 아렌트의 사유 편린을 연대기적으로 추적하였다. 첫째, 20세기 전반 유럽 국민국가의 쇠퇴와 법 전통의 종말을 입헌주의 관점에서 진단한다. 둘째, 그 해결책으로 그리스의 노모스와 로마의 렉스 개념이 지니는 법철학적 함의를 고찰한다. 셋째, 혁명과 건국 과정을 중심으로 정치적 자유를 보장하는 헌법사상을 고찰한다. 넷째, 아이히만 재판을 계기로 정의와 자유가 우리의 정치적 삶에 지니는 의미를 검토한다. 특히 인류에 반하는 범죄 문제를 관할하는 국제형사재판소의 설립 요구와 관련한 형법사상을 검토한다. 다섯째, 오늘날 지구적 쟁점들을 해결하기 위해서 적극적인 연대와 정치적 책임의 중요성을 부각한다.

영문 초록

The humankind has experienced the changes from the age of the nation-state through the imperialistic age and century of the violence to the age of globalization. Anyone is and ought to be not only the citizen in one nation among nations but also one person belonging to the humanity, who considers the whole globe as the home. We must consider the importance of interrelation between law and politics, which is capable of living the life of humaneness. Any national law connected with the politics should remain to be the hedge which protects the freedom as political reality. Faced with the emerging various kinds of the global emergency, we should take into consideration not only solidarity and cooperation as the action but also the legal institutions which are able to guarantee politics and the political. To search the solution to these problems, I has followed chronologically Arendt’s thought-fragments on the interrelation between politics and law as follows: ⑴ diagnosing the decline of modern European nation-states and the end of legal tradition under the Nazi in the first half of 20th century; ⑵ illuminating the implications of Greek Nomos and Roman Lex; ⑶ emphasizing the justice and the freedom as the important elements of political life, and Arendt’s futuristic demand on the founding of international criminal court; ⑷ exposing the positive solidarity and political responsibility which can contribute to solve the global issues today.
