重混时代下中国重混创作权的构建研究

국문 초록

随着数字网络技术的发展，公众对于作品的使用、创作、传播能力进一步增强。数字网络技术为获取作品带来新的手段与方式，也进一步引发了创作者对已有的文字、音乐、视频等作品进行重新组合创作新作品的重混文化现象。重混作品在促进文化多元化的同时也引发了许多著作权问题，而目前中国著作权法对重混行为并没有明确规定，这不利于保护重混创作者的创作积极性。因此本文从具体司法案例出发分析现有著作权保护的不足，并尝试提出将重混作品纳入著作权法保护范围、为重混创作者设立重混创作权、引入知识共享协议等建议，以平衡权利人与使用者间的利益分享，构建与重混创作相适应的法律制度。

영문 초록

With the development of digital network technology, the public’s ability to use, create, and disseminate works has further enhanced. Digital network technology has brought new means and methods to obtain works, and has further triggered the phenomenon of remixing culture where creators recombine existing works such as text, music, and videos to create new works. While promoting cultural diversity, remixed works have also raised many copyright issues. Currently, China’s copyright law does not explicitly regulate remixed behavior, which is not conducive to protecting the creative enthusiasm of remixed creators. Therefore, this paper analyzes the shortcomings of existing copyright protection from specific judicial cases, and attempts to propose suggestions such as incorporating remixed works into the scope of copyright law protection, establishing remixed creation rights for remixed creators, and introducing knowledge sharing agreements. A legal system suitable for remixed creation should be constructed in order to balance the benefit sharing between rights holders and users.
