교정과 인권 -형의 집행 및 수용자의 처우에 관한 법률 및 헌재결정을 중심으로-

국문 초록

본고는 교정과 인권의 문제에 관해서 형의 집행 및 수용자의 처우에 관한 법령의 개선내용과 헌법재판소의 결정, 법원의 판결 등을 고찰하였다. 수용자 처우에서의 차별문제, 접견교통의 문제, 노약자 · 여성 등에 대한 처우 특히 의료처우의 문제, 전자장비 사용제한의 문제, 조폭사범 등에 대한 특별관리의 문제, 징벌유형의 확대문제, 술 담배 등과 관련된 문제, 과밀수용 문제 등등 하나하나가논문의 주제가 될 수 있는 내용이라 생각한다. 차후 논문에서는 이에 관한 내용을 고찰하고자 한다. 수형자 역시 사회적 인간이라는 측면과 재사회화의 관점에서 볼 때, 수형자에대해 자유권 박탈 이외에 추가적인 고통이 필요한 것인가 하는데 의문을 제기한다. 수형자 인권의 차원에서는 더욱 아닐 것으로 사료된다. 교정과 인권은 같이동반되어야 한다. 수형자의 인권과 관련하여 비례의 원칙을 강조하며, 인권이 존중되는 수형자처우가 이루질 때 진정한 교정, 재사회화가 이루어지리라는 생각이다. 따라서 교정시설의 안전성 확보 및 사고방지가 중요하다고 하여 치료감호대상자에 대한계호방법을 강화한다거나, 최근 탈주범 신창원의 경우 CCTV를 제거했지만 구금시설 내에 CCTV를 설치 녹화하는 것은 인권침해의 소지가 많다고 본다. 끝으로 수용자의 인권과 교도관의 노동기본권은 비례한다고 보아, 교도관의근무여건 개선도 이루어져야 한다고 본다.

영문 초록

This paper examines the improvements in laws and regulations regarding the execution of sentences and the treatment of prisoners on matters of correction and human rights, decisions of the Constitutional Court, and court decisions. Discrimination in the treatment of prisoners, problems with interview traffic, the elderly · I think that the problem of treatment of women, especially the issue of medical treatment, the problem of restrictions on the use of electronic equipment, the issue of special management of gangsters, the expansion of punitive types, problems related to alcohol cigarettes, and overcrowding, etc., can be the subject of each paper. In future papers, we will consider this. In terms of social humanity and socialization, the question is whether the person in the prison needs additional pain in addition to the deprivation of free rights. It is believed that this is not even the more in terms of the human rights of the number of people in the human rights. Corrections and human rights should be accompanied together. It emphasizes the principle of proportionality in relation to the human rights of the detainees, and believes that true correction and resocialization will be achieved when the treatment of the recipients, where human rights are respected, is achieved. Therefore, the safety of correctional facilities and the prevention of accidents is important to strengthen the system for treatment and crime prevention, or recently, in the case of the fugitive new changwon, but the removal of CCTV, but the installation and recording of CCTV in the detention facility is seen as a lot of possession of human rights violations. Finally, the human rights of the prisoners and the basic rights of the guards to labor are proportional, and the working conditions of the guards should also be improved.
