국문 초록

행정부의 위계 내에 존재하는 전통적인 관료적 책무성은 관료제 조직의 전문가적 책무성을 보장하는 데 필요한 재량이나 자율성을 제약하는 경향이 있다. 그러나 하나의 정부 조직에 대해 관료적 책무성과 전문가적 책무성이 동시에 기대될 경우 전문가적 규범과 표준에 기반한 재량권의 보장은 필수적이다. 본 연구는 법제처가 법령해석제도를 운영함에 있어 중립적 역량(neutral competence)에 대한 제도 이용자들의 기대로부터 비롯되는 전문가적 책무성의 관련 요소들 및 반응적 역량(responsive competence)에 대한 대통령의 기대로부터 비롯되는 관료적 책무성의 관련 요소들이 법제처가 법령해석요청에 회신하는 데 소요되는 기간에 미치는 영향에 대해 실증 분석을 실시했다. 분석 결과 법제처 법령해석제도는 첫째로 제도의 설계 차원에서 통제를 가하기보다는 광범위한 재량을 허용하는 경향이 있으며 둘째로 제도의 핵심 목표가 명확히 설정되어 있기에 다양한 수준에서 두 형태의 책무성을 동시에 성공적으로 유지하고 있음을 발견하였다.

영문 초록

Traditional bureaucratic accountability within an administrative hierarchy tends to limit the discretion or autonomy that is needed to ensure professional accountability. However, when a government organization is expected to demonstrate both forms of accountability at the same time, discretion based on professional norms and standards becomes vital. On the basis of empirical evidence, this study examined the effect of professional accountability factors, derived from the expectation of neutral competence on requesters, and bureaucratic accountability factors, derived from the expectation that the President is responsive, on the response time of the Statutory Interpretation System (SIS) of the Ministry of Government Legislation of South Korea (MGLK). We find that the MGLK has been successful at maintaining both forms of accountability at varying degrees with regard to the SIS because its institutional design guarantees widespread discretion—rather than control—while also clearly referencing the primary goal of the system.
