반대통령제(semi-presidentialism) 정부형태와 반대통령제 개헌론에 관한 연구

국문 초록

대한민국은 1948년 정부수립 이후 사실상 줄곧 대통령제를 채택해 왔다. 그런데 대통령제 본연의 모습이 아닌 ‘제왕적 대통령제’로 변질되어 대통령이 무소불위의 권력을 행사하는 문제점이 드러났다. 박근혜 대통령 탄핵과정에서 드러난 정치권의 실체에 우리 국민은 경악과 참담함을 금하기 어려웠다. 대통령이 그토록 무능하고 부패할 수 있는가, 그런 대통령을 견제하고 통제해야 할 국회는 그토록 무기력하고 무책임할 수 있는가. 대통령에 대한 견제와 통제 시스템이 없는 것인가, 아니면 있음에도 불구하고 작동하지 않은 것인가. 이련 물음과 함께 대통령 탄핵 후 개헌론이 활성화 되었다. 이 기회에 제왕적 대통령제를 바꿔야한다는 공통된 인식하에 대안 중 하나로 제시된 정부형태는 반대통령제(semi presidentialism)이다. 반대통령제는 현행 대통령제가 안고 있는 문제점을 해결해 줄 수 있는 진정한 대안인가. 본고는 이런 물음에서 시작되었고, 그 답을 찾기 위해 반대통령제에 대한 일반론을 알아보고 반대통령제를 취한 세계 각국의 운용실태를 살펴본 후 현행 정부형태 대안으로서의 반대통령제 도입 여부에 대한 논쟁을 고찰해 본다. 어쩌면 우리는 지급 ‘개헌 유토피아’ 또는 ‘개헌 만능주의’에 빠져 있는 것은 아닐까. 현행 청부형태의 실패를 고스란히 대통령제도 자체의 문제로 치부하고 그 자체를 폐기하거나 대폭 수선하려는 생각은 과연 옳은 것인가 현행 대통령제의 문제점을 근본적으로 해결하는 길은 정부형태의 양대 축 중 하나이면서 대통령을 견제·통제할 수 있는 국회의 권한을 강화하는 것이다. 그런데 지금까지 대통령에 대한 견제·통제 역할을 전혀 못한 국회 개혁은 미룬 채, 즉 후진적 정치토양은 그대로 둔 채 대통령제만 손질하면 해결되는 것인가. 정부형태가 제대로 운용되려면 대통령이 대통령다워야 하고 국회는 국회다워야 한다. 촛불혁명을 통해 대통령은 (비록 아직은 갈 길이 멀다 하더라도) 점점 대통령다워지고 있지만, 국회는 여전허 구태의연한 모습을 보이고 있다. 그렇다면 우리의 당면과제는 정부형태 개헌이라기보다는 국회를 개혁하는 일이 아닐까. 국회를 개혁하여 국회를 국회답게 만드는 일은 춧불혁명의 진청한 완성으로 가는 길일 것이다.

영문 초록

Since the establishment of the government in 1948, the Republic of Korea has always adopted the presidential system. Unlike the original presidential system, however, there was a problem that the president became the so-called “Imperial president” who exercised absolute power. Through the impeachment proceedings of President Park Geun-hye, it was revealed that she confidentially used unchecked presidential power and exercised political influence. People were shocked and thought this was a tragedy. After the impeachment of the President, the people questioned the President's irrationality and corruption. Also, it was skeptical about the incompetence and irresponsibility of the National Assembly, which has the obligation to control the president. Thus, to change the check and control system for the president, the issue of amending the constitution is surfacing again. Under the common perception that this occasion should change the form of government, “semi-presidentialism” is convincingly discussed among the new forms of government. This study began with the question of whether semi-presidentialism can solve the problems of the current presidential system in Korea It examines the general theory of the semi-presidential system and refers to the actual situation of the countries around the world that took the semi-presidential system. And also the debate about the need for introduction as an alternative to the current form is treated. Do we believe that everything will be resolved by the constitutional amendment? It is necessary to consider whether the current government's failure should be regarded as a problem of the presidential system itself and whether it is right to improve the system significantly or modify it In order to fundamentally solve the problems of the current presidential system in the Republic of Korea, it is important to strengthen the powers of the National Assembly to cany out its role of checking against the abuse of power by the President In order for the government to function properly, changes in the president and the National Assembly are needed. By the Candlelight Revolution, the presidency seems to be improving, but the National Assembly remains as it was. We should think that we can not change the presidential system without reforming the National Assembly. Therefore it is time to put everyone's heads together.
