국문 초록

이 글은 지방자치법상의 특별지방자치단체 개념에 대한 회의론에서 출발한다. 어떻게 보면, 이미 논의를 거쳐 제도화된 법적 정의(定義)에 대한 딴죽걸기로 보일 수 있겠으나, 제도나 개념에 관한 정의는 그 운영과 성과를 담보할 수 있다는 점에서 그간 주목되지 않았던 부분에 대해 의문을 남기기로 한다. 우리 입법자는 효율적이고 경쟁력을 가진 광역행정을 수행하는 특별지방자치단체의 설치를 새로이 설계하였다. 지방의 소멸과 고사에 대응하는 위로 보는 관점에서도 새로운 지방행정 체계의 제도설계를 위한 아래로 멀리 보는 관점에서도 지방자치단체의 참여로 만들어진 협력체의 등장은 현행 지방자치단체의 권한과 사무 및 자치권에 대한 변화를 예상할 수 있다. 행정안전부로부터 설립 규약의 승인을 받은 설립되는 특별지방자치단체는 지역이 주도하는 균형발전 전략으로서 초광역 협력의 선도모델이라는 점과 광역행정을 수행하는 지방정부의 출현에 앞선 과도기 상태의 모습이라는 의미를 찾을 수 있다. 그러나 특별지방자치단체가 무엇인가에 대해 지난 20년간 그 존재의 구체화에 대한 언급에도 불구하고 이에 대한 규범적 논의와 검토는 부족했다고 본다. 수식어로 붙인 ‘특별한’에 대하여 일반 지방자치단체와 구별되는 고유한 특성과 관련해 새로 생산된 개념이 수행하는 기능의 특수성 보다 존재의 독자성에 대한 고민이 있어야 일반 지방자치단체와 다른 지방자치단체의 카테고리를 인정받게 될 것이다. 현재의 특별지방자치단체 개념을 그대로 유지할 것인지에 대해서도 “일반” 지방자치단체와 대칭되는 의미부터 연상되는 “특별”지방자치단체 개념 대신에 지방자치단체의 협력을 위한 개별 입법방식을 통해 불필요한 논쟁을 마치는 것이 적절한 해결방안이라 할 것이다.

영문 초록

On this paper, we hope to have a discussion with skepticism about the concept of special local governments under the Local Autonomy Act. In a way, it can be seen as a different bet on legal justice that has already been discussed and institutionalized, but the definition of a system or concept can guarantee its operation and performance, so we will leave questions that have not been noted. Our legislator newly designed the establishment of a special local government that conducts efficient and competitive metropolitan administration. From the perspective of consolation in response to the disappearance and examination of local governments, the emergence of cooperatives created by the participation of local governments can predict changes in the authority, affairs and autonomy of local governments. The established special local government approved by the Ministry of Interioe ans Safety is a balanced development strategy led by the regional authority(Busan· Ulsan·GyeongNam) ultra-wide cooperation and a transitional state prior to the emergence of local governments conducting wide-area administration. However, despite mentioning the concreteization of its existence over the past 20 years on what a special local government is, normative discussions and reviews on this have been insufficient. Regarding the unique(sui generis) characteristics distinguished from general local governments, the category of general local governments and other local governments will be recognized only when there is concern about the uniqueness of the function performed by the newly produced concept. Whether to maintain the current concept of special local governments is also an appropriate solution to end unnecessary debate through other special legislative methods for cooperation of local governments instead of the concept of special local governments, which is reminiscent of the meaning of symmetry with general local governments.
