한일회담 문화재 반환 협상의 재조명

국문 초록

한일회담의 문화재 반환 협상은 많은 비판을 받아왔다. 이러한 비판들은 동 협상이 실패했다는 결과에 초점을 둔 나머지, 당시 한국 측이 불리한 상황 속에서 한일회담과 동 협상에 임해야 했다는 점, 주요 문제에 대해 한국 측의 주장을 관철시켰다는 점, 그리고 그것이 동 협상에서 가지는 의미 등은 충분히 검토하지 않았다. 이에 본고는 문화재 반환 협상에 대한 보다 균형 잡힌 해석을 위해 ‘문화재 반환 관련 회의 개최 문제’, ‘문화재 목록 제출 문제’, ‘반환과 기증 문제’를 검토하면서 동 협상을 재조명해 보았다. 한국 측은 ‘문화재 반환 관련 회의 개최 문제’에 있어서 일본 측을 설득시켜 문화재소위원회, 전문가회의를 개최하였고, 이는 문화재 문제가 구체적으로 논의되는 계기가 되었다. 또한 ‘문화재 목록 제출 문제’에 있어서 소극적인 태도를 보이는 일본 측에게 문화재 목록을 수차례 제시하면서 일본 측을 구체적인 논의로 끌어들였다. ‘반환과 기증 문제’에 있어서는 기증을 주장하는 일본 측을 설득하여 반환의 명목을 인도로 타협했다. 한국 측은 문화재 반환 협상에서 일본 측의 소극적인 태도 혹은 반대에도 불구하고 위와 같은 문제에 대해 자신의 주장을 관철시켰던 것이다. 한일회담의 문화재 반환 협상은 한국 측의 일방적인 양보가 아니었으며, 당시의 불리한 상황 속에서 일본 측을 설득시켜 현실적인 결과를 얻어낸 협상이었다.

영문 초록

The negotiation on the return of cultural properties in the Korea-Japan talks have been highly criticized in Korea. The existing literature on the talk has limited the efforts of scholars to address the structural disadvantages korean delegates had in the process of negotiations and point out the partial success of outcomes in the talks. This study rethinks the negotiation on the return of cultural properties through these review and tries a more balanced interpretation of the negotiation. When it comes to ‘conferences on the issue of the return of cultural properties’, Korea pushed its agenda on the return of cultural properties by establishing a cultural property sub-committee and expert meeting. In the case of ‘cultural property list issue’, Korea took the lead in discussions by submitting the list of cultural property to Japan which showed a passive attitude. In the ‘return and donation issue’, Korean delegates had led to the compromise to define the return of cultural property ‘turn over’ as return, rather than ‘donation’ Japan preferred. Korea, in spite of Japan’s passive attitude or opposition to the negotiation on the return of cultural properties, has made its assertions about the above problems. The negotiation on the return of cultural properties were not a one-sided concession by Korea but he outcome of compromises which brought the significant concession of Japan.
