군사의무에 대한 공법적 검토

국문 초록

본 연구는 국방 분야의 기본이 되는 국방의무의 개념과 구체적으로 국민이 가지게 되는 군사의무, 병역의무의 내용을 분석하였다. 특히 헌법재판소에서 국방의무에 비군사적 의무도 포함된다고 하고, 병역의무도 역시 마찬가지로 비군사적 의무가 포함된다고 보고 있는데 본 연구에서는 이를 비판적으로 검토하였다. 병역의무는 군사적 의무의 하나로 보는 것이 타당하고 비군사적 의무는 병역의무에서 개념상 구분하는 것이 타당하다. 군사의무를 내용으로 하는 ｢병역법｣, ｢비상대비에 관한 법률｣ 등에서 규정하고 있는 “전시․사변 또는 이에 준하는 국가비상사태”라는 요건을 검토하였다. 군사대비를 위하여 해당 요건을 완화하여 전시 등이 임박하였을 때 군사의무를 부담하도록 하는 것을 적극적으로 검토할 필요가 있다. 아울러 전시 군사의무를 내용으로 하는 전시대기법(안)이라는 특이한 형태가 있는데, 이는 아직 법률의 효력을 갖춘 것이 아니므로 이와 같은 방식은 법치주의 관점에서 타당하지 못하다. 마지막으로 최근 미국에서 큰 관심사로 떠오른 국방물자생산법을 살펴보았다. 계획되지 아니한 물자생산의 경우, 동원이나 징발의 개념과 구분되지만 우리 헌법 제126조를 근거로 하여 우리도 국방물자생산법을 만들 수 있다고 할 것이다. 별도 법률로 제정하지 아니할 경우 ｢방위사업법｣의 긴급 조달 등의 방식으로 필요한 물건을 생산하게 할 수도 있다.

영문 초록

This study analyzed the concept of national defense duty, which is the basis of the defense field, specifically the military duty and military service obligations that the people have. In particular, the Constitutional Court said that non-military obligations are included in national defense duty, and military service obligations are also considered to include non-military obligations, which was critically reviewed in this study. It is reasonable to view military service obligations as one of military duty, and it is reasonable to distinguish non-military obligations conceptually from military service obligations. The requirements of "in times of war, national crisis or other similar emergencies" stipulated in the Military Service Act and the Emergency Readiness Act, which contain military duty, were reviewed. In order to prepare for the military, it is necessary to actively review the requirements to be relaxed to bear military duty when war, etc. is imminent. In addition, there is a unique form of the War Readiness Reserve Act (Bill), which contains wartime military duty, which does not have the effect of the law yet, so this method is not valid from the perspective of the rule of law. Finally, we looked at the Defense Production Act, which has recently emerged as a major concern in the United States. In the case of unplanned material production, it is distinguished from the concept of mobilization or requisition, but it is considered possible to enact the Defense Production Act based on Article 126 of the Korean Constitution. Otherwise, the necessary goods may be produced by emergency procurement of the Defense Acquisition Program Act.
