청소년 한부모의 가족구성권에 대한 비판적 탐구

국문 초록

이 연구는 국가의 정책과 제도 속에서 청소년 당사자가 가족을 구성하고 사회적으로 그 지 위를 인정받는 ‘청소년 한부모가족’ 모델에 주목한다. 재생산과 인구를 둘러싼 논의 지형 속 에서 청소년 한부모의 역할과 책임을 성찰함으로써 정상가족 패러다임과 청소년의 미성숙성 에 대한 전제에서 청소년정책과 가족정책의 딜레마를 분석하였다. 이를 통해 청소년 한부모 에게 허용되는 가족구성권의 의미와 한계를 살펴봄으로써 청소년의 성적 지위와 역할을 둘러 싼 사회적 관점을 재검토하고자 한다. 이에 이 연구는 첫째, 청소년 한부모를 지원하는 가족정책의 변천 과정에 대해 개괄한다. 이를 통해 가족정책 내에서의 청소년의 지위와 요청되는 자격, 정책의 규범적 성격을 분석한 다. 둘째, 청소년 한부모 당사자가 존중받아야 하는 권리들을 검토한다. 청소년 임신과 출산 에 대한 지원과제에 있어 위기청소년을 ‘생산적인 인구’로 호명하면서 다양한 노력과 지원의 필요성이 지적되는 현실에는 청소년의 섹슈얼리티에 대한 인식의 전환과 성적 주체의 권리 를 요구하는 과정이 밀접하게 결합된다. 나아가 청소년의 임신, 출산, 자녀 양육을 둘러싸고 청소년 당사자가 존중받아야 할 선택과 권리에 대한 논의와 특정집단으로서 청소년 한부모 가 사회구조적으로 보호되어야 한다는 정당성 사이에서 간과되어 있는 쟁점을 분석한다. 마 지막으로, 향후 청소년이 가족을 구성하는 과정, 즉 가족구성권이 실현되어야 할 과제를 제 안한다.

영문 초록

This study focuses on the right for ‘family equality’ of adolescent single parents’ families. Their status is recognized or supported in society within the national policies and systems. This study analyzed the dilemma of adolescent single parents between family policy on the premise of the normal family paradigm and adolescent immaturity by reflecting on the roles and responsibilities of adolescent single parents in the discussion landscape surrounding reproduction and population. By examining the meaning and limitations the right for family equality, we intend to criticize the social perspective surrounding the sexual status and roles of adolescents. Therefore, first of all, we outlined the transition process of family policy that supports adolescent single parents. Accordingly, the status of youth within family policy, the required qualifications, and the normative nature of the policy were analyzed. Second, we reviewed the rights required and respected by youths involved in youth single-parent families. In terms of supporting adolescent pregnancy and childbirth, the need for various efforts and support is pointed out while calling ‘crisis youth’ as productive population. In this respect, the transition of adolescents perceptions of sexuality and the process of demanding the rights of sexual subjects are closely combined. In particular, We analyzed the issues that emerged between the choices that adolescents should be respected in the process of pregnancy, childbirth, and parenting, the rights surrounding them, and the legitimacy that adolescent single parents as a specific group should be structurally protected. In conclusion, It is required that the process of forming a family in the future should develop in the direction of realizing the right for family equality among all the different families.
