보조금 부정수급방지를 위한 재정법적 고찰

국문 초록

국가 및 지방자치단체의 전체예산에서 보조금이 차지하는 비중이 늘어남에 따라 보조금 부정수급 문제에 관한 관심도 커지고 있다. 이 글은 보조금 현황과 보조금 부정수급의 다양한 유형과 사례들과 보조금관련 법령의 체계와 구조를 살펴보고, 보조금 부정수급을 방지하는 해법에 대하여도 모색해보고자 하였다. 그 동안 보조금관련 법령의 체계에 상당한 변화가 있었다. 국가재정법과 지방재정법 등에 산재되어 규정된 보조금 관련 규정들이 보조금 관리에 관한 법률과 지방자치단체 보조금 관리에 관한 법률로 옮겨 통일적으로 규정되고 이후 공공재정환수법이 제정되어 보조금을 포함한 공공재정 전반에 관한 부정청구 및 환수 등에 관한 내용이 포함되었다. 이로써 보조금관리에 관한 법률 등에 있었던 법적인 허점이 보완 된 것은 사실이나 여전히 법적 체계나 구조에 있어서 문제가 남아 있다. 먼저 보조금관리법과 공공재정환수법의 관계설정의 문제가 양 법의 적용문제와 관련하여 제기될 수 있는 바, 보조금관리법의 대상이 되는 보조금에 대해서는 우선 보조금관리법이 적용되고 보조금관리법의 대상이 되지 않는 보조금이나 동법의 대상이 되더라도 법의 허점으로 인하여 환수대상에 포함되지 않는 등의 경우에는 공공재정환수법이 보충적으로 적용되는 관계에 있음을 지적하였다. 그러나 공공재정환수법 역시 여전히 보완이 필요한 부분이 있다. 특히 공공조달계약에 대해서는 공공재정환수법이 적용되지 않고 있는 바, 해외의 입법례는 조달계약에 대해서도 이를 환수하고 처벌하는 규정을 두고 있으므로 이를 반영하여 법을 개정할 필요가 있다. 또한 부정수급에 대한 제재수단이나 거버넌스체계 등에 대하여 개정의 필요성이 있으며 그 밖에 통합관리시스템 구축이나 사후평가제도의 구체화 등도 필요하다. 보조금환수 등 공공재정 환수제도 운영기반을 마련하여 부정수급을 예방하고 눈먼 나랏돈은 없다 는 공공재정에 대한 국민의 인식이 전환될 필요가 있다. 앞으로도 지속적으로 법적, 제도적인 해법을 고민함으로써 공공재정의 건전성 및 투명성이 강화되어 반부패, 청렴의 사회분위기가 조성될 수 있도록 노력하여야 한다.

영문 초록

As the proportion of subsidies in the total budget of the state and local governments increases, interest in the issue of subsidy irregularities is also growing. This article aims to examine the current status of subsidies, various types and cases of subsidy irregularities, and the system and structure of subsidy-related laws, and to seek solutions to prevent subsidy irregularities. In the meantime, there have been significant changes in the system of subsidy-related laws. Subsidy-related regulations scattered throughout the National Finance Act and Local Finance Act were transferred to the Subsidy Management Act and the Local Government Subsidy Management Act and stipulated uniformly. Contents on claims and refunds were included. It is true that the legal loopholes in the subsidy management law have been supplemented, but there are still problems in the legal system and structure. First, the issue of establishing a relationship between the Subsidy Management Act and the Public Finance Repatriation Act can be raised in relation to the application of both laws. For subsidies subject to the Subsidy Management Act, the Subsidy Management Act applies first, and subsidies not subject to the Subsidy Management Act. However, it was pointed out that the Public Finances Redemption Act is supplementary to the cases where it is not included in the redemption target due to loopholes in the law even if it is the subject of the same law. However, there are still areas that need to be supplemented in the Public Finance Redemption Act. In particular, as the Public Finance Redemption Act does not apply to public procurement contracts, foreign legislative cases have provisions for recovering and punishing procurement contracts, so the law needs to be revised to reflect this. In addition, there is a need to revise the means of sanctions against illegal supply and demand and the governance system. In addition, it is necessary to establish an integrated management system and to materialize the ex post evaluation system. It is necessary to prepare a foundation for the operation of a public finance return system, such as subsidy return, to prevent illegal supply and demand, and to change the public s perception of public finance that there is no such thing as blind money. Efforts should be made to create a social atmosphere of anti-corruption and integrity by strengthening the soundness and transparency of public finance by continuously considering legal and institutional solutions.
