중고령자 및 노인을 대상으로 한 연령차별에 관한 사례연구

국문 초록

연구에서는 국가인권위원회의 판결문이 연령차별의 이유를 탐색하고자 하는 연구 목적에 적합하다고 보고 이를 분석자료로 활용하였다. 국가인권위원회결정례집 1집부터 7집까지 내용 중에서 50대 이상 연령과 관련된 연령차별 20건을 우선 대상으로 삼아 최종 분석에 포함시켰다. 국가인권위원회 결정례집 판결문을 내용분석하는 도구로 Strauss and Cobin의 근거이론 가운데 개방코딩 방법을 활용하였다. 연구자가 판결문을 읽고 차별 이유에 해당하는 문장과 문구를 뽑아서 각각의 주요 의미단어를 추출하였다. 근거이론의 개방코딩에 따라 의미단어를 하위개념으로 파악, 하위개념-하위범주-범주의 순서로 유목화를 실시하였다. 본 연구에서는 노인의 차별 요인을 규명하기 위하여 국가인권위원회 차별사건 판결문을 근거이론의 개방코딩에 의해 분석한 결과, 최종적으로 4개의 상위 범주를 추출하였고 이를 차별요인으로 파악하였다. 4개의 상위 범주는 비용적, 세대 교환, 연령주의, 시간전망 등이다. 본 연구의 의의는 고령자 고용차별과 관련하여 차별 요인을 규명하였다는 점이다. 특히, 상위범주로 4가지 요인을 제시한 것은 향후 연령차별의 원인을 제거함으로써 고령자에 대한 연령차별을 해결하는데에 중요한 점을 제시한 것으로 볼 수 있다. 한편, 본 연구의 한계점은 국가인권위의 판결문 내용을 분석함에 있어서 딱딱한 판결문의 성격에 의하여 많은 의미를 추출하지 못했다는 점에 한계가 있기에, 향후 연구에서는 인터뷰 및 관찰 방법을 동원하여 좀더 풍부한 의미들이 도출될 수 있는 연구가 이루어져야 할 것이다.

영문 초록

In this study, we take advantage of them reported that this decision of the National Human Rights Commission to explore suitable for research purposes for reasons of age discrimination in analysis. In this study, in order to identify discriminatory factors in the elderly National Human Rights Commission it analyzed the cases of discrimination ruling by the open coding of grounded theory, and finally extract the four top categories had been identified it as a differentiator. Four high-cost category, the three exchanges, age care, time prospects. The significance of this study was to identify factors related to discrimination, employment discrimination is that elderly people. In particular, the proposed four factors to a higher category, it can be seen as a presenting important to solving the age discrimination against the elderly by removing the cause of a future age discrimination. On the other hand, a limitation of this study is itgie a limit on failed to extract much meaning by the nature of the rigid ruling in In analyzing the National Human Rights Commission decision information is that,in future studies to mobilize the interview and observation method to be richer meaning they derive the research will be done.
