국문 초록

본 연구는 디지털 정보화시대 뉴미디어인 소셜미디어에 의한 명예훼손 및 면책사유에 관한 논의와 그에 대한 연구를 통해 적절한 대응방안을 제시하는데 연구목적을 두고 모색하였다. 소셜미디어 이용확대로 모바일의 활용도가 커지고 소셜미디어의 이용이 보편화, 생활화되면서 어느 나라에서나 명예훼손성 표현의 범람과 그 적절한 규제방식에 대해 많은 논의와 모색이 이루어지고 있다. 사이버 공간에서는 전통적인 매체에 비해 광범위하고 급속하게 피해가 확산되고, 표현물의 최초의 정보 제공자가 명확히 드러나지 않는 익명성으로 인해 그 폐해가 더욱 크다. 물론 명예훼손의 우려가 커질수록 표현의 자유는 위축될 수밖에 없다. 그러나 공공성과 진실성을 가진 정보는 명예훼손보다 먼저 보호되는 것이 일반적이다. 공공의 이익은 국가나 사회전체의 이익과 직접적인 관련을 지닌 것뿐만 아니라 부분적으로 사익에 관한 것도 포함되는 것으로써 구체적인 사안에 따라 판단해야 한다. 또한 판단자의 정치성향과 가치관 및 사회적 영향 등 판단의 경중에 대한 편향성을 방지하기 위해서 미리 법률로써 구체적인 규정에 의거한 죄형법정주의를 통해 명확성의 원칙을 지키는 것이 바람직 할 것이다. 본 연구에서는 소셜미디어에 의한 명예훼손에 대해서 표현의 자유를 최대한 보장하면서 타인의 인격권인 명예를 훼손하는 행위를 규제할 수 있는 합리적인 절충안을 찾고자 한다.

영문 초록

The purpose of this study was to propose appropriate countermeasures through discussions on the reasons for defamation and immunity caused by social media, a new media in the digital information age, and research on them. As the use of mobile becomes larger due to the expansion of social media use, and the use of social media becomes more common in everyday life, many discussions and explorations are being made about the inundation of defamation expressions and appropriate regulatory methods in any country. In cyberspace, damage spreads more widely and rapidly than in traditional media, and the damage is even greater due to the anonymity that the first information provider of the expression is not clearly revealed. Of course, as the fear of defamation increases, freedom of expression inevitably shrinks. However, information with publicity and integrity is generally protected prior to defamation. Public interests are not only directly related to the interests of the state or society as a whole, but also partly related to private interests, and should be judged according to specific issues. In addition, it would be desirable to adhere to the principle of clarity through the principle of clarity in accordance with specific regulations in advance in order to prevent bias in the weight of judgment, such as political orientation, values, and social influence of judges. This study seeks to find a reasonable compromise that can regulate the defamation of others personal rights, while guaranteeing the maximum freedom of expression against defamation caused by social media.
