남북한 문화재보호법제의 상호교류를 위한 기초의 연구

국문 초록

남북 관계의 발전적 개선을 위한 제도적 기초로서 법제정비지원을 통한 남북 간의 법제교류 증진이 요청된다. 다만 현재 교착되어 있는 남북 관계를 고려할 때, 우리는 남북 간에 공감대를 형성하면서 보다 쉽게 교류를 확대해 나갈 수 있는 분야에서부터 법제교류 및 법제정비지원을 도모할 필요가 있다. 그리고 우리는 ‘문화재보호법제’를 그 대표적인 분야 가운데 하나로 평가할 수 있다. 이 연구는 북한의 문화재보호법제의 발전 및 변천과정을 살펴보고, 남북한 문화재보호법제의 주요 사항에 대한 비교・검토를 행함으로써 남북한 간 법제교류 및 법제정비지원을 성공적으로 수행하기 위한 기초자료를 제공하고자 하였다. 다만 특히 문화재보호법제는 민족적 긍지의 바탕에 작용하는 것으로서 남한 법제의 일방적 이식의 대상이 아니라 어디까지나 법제의 상호교류의 대상이며, 따라서 상당 부분 북한의 특수성을 고려할 필요가 있다. 이와 같은 법제의 상호교류 과정에서 남북한 간의 신뢰가 제고된다면, 장차 남북 사이의 문화적 동질성에 기초하여 통일을 모색하기 위한 일 방안으로서 남북한 간 문화협정을 체결하거나, 문화재와 관련한 민・관의 상호교류 및 협력을 보다 증진시키기 위한 남북합의서를 체결하는 방안도 강구해 볼 수 있을 것이다. 혹은 반대로 이와 같은 문화협정 내지 남북합의서의 체결을 통하여 남북한 간 법제의 상호교류가 보다 적극적으로 진전될 수도 있을 것으로 생각된다. 이와 같은 법제교류의 제도적 기초를 바탕으로 한반도의 문화재, 즉 민족문화유산의 보호를 위한 남북한의 협력방안을 보다 적극적으로 모색하여야 할 것이다. 그리고 현재 북한이 문화재 국제교류 및 세계유산 등재에 상당한 관심을 지니고 있는 점을 감안할 때, 기존의 경험과 성과를 바탕으로 남북한의 우수 문화재를 세계유산으로 등재하기 위한 남북 공동의 노력과 시도는 남북 관계의 개선을 위한 마중물로서의 역할을 충분히 해낼 것으로 기대된다. 또한 이의 연장선상에서 해외 반출 문화재의 환수를 위한 남북 공동의 노력 역시 요청된다 할 것이다.

영문 초록

As an institutional basis for the developmental improvement of inter­Korean relations, it is requested to promote legal exchange between the two Koreas through legal technical assistance. However, considering the inter­Korean relations that are currently stalemate, we need to promote legislative exchange and legal technical assistance in areas where exchanges can be expanded more easily while forming a consensus between the two Koreas. And we can evaluate the Cultural Heritage Protection Act as one of its representative fields. This study looked at the development and transition process of North Korea s cultural heritage protection legislation, and compared and reviewed the major issues of the inter­Korean cultural heritage protection legislation to provide basic data for successful inter­Korean legislative exchange and legal technical assistance. However, in particular, it is important to keep in mind that the cultural heritage protection legislation works on the basis of national pride, and is not a subject of unilateral transplantation of the South Korean legislation, but a subject of cross­fertilization of legislation. Therefore, it is necessary to consider the specificity of North Korea to a large extent. If trust between the two Koreas is enhanced in the process of such legislative exchange, it may be possible to find a plan to conclude a cultural agreement between the two Koreas as a way to seek reunification based on cultural homogeneity between the two Koreas in the future. In addition, it is possible to devise a plan to conclude a South­North Korean agreement to further promote public­private exchanges and cooperation related to cultural heritage. On the contrary, it is thought that the inter­Korean legislative exchange could be promoted more actively through the conclusion of such cultural agreements or South­North Korean agreements. It is necessary to actively seek a plan for cooperation between the two Koreas to protect the cultural heritage of the Korean Peninsula, that is, national cultural heritage, based on the institutional basis for such legislative exchange. In addition, given that North Korea currently has considerable interest in international exchange of cultural heritage and World Heritage listing, the joint efforts and attempts by the two Koreas to list outstanding cultural heritage as a World Heritage Site based on previous experiences and achievements are expected to serve as priming water for improving inter­Korean relations. As an extension of this, joint efforts by the two Koreas to recover cultural heritage taken out of the country will also be called for.
