국문 초록

1949년에 창설된 군 형무소는 1950년대 말 까지는 교화보다는 정치적 응보주의 이념이 강했고 강력한 반공주의와 군사주의에 기초한 박정희 정권하에 제정된 군 행형법은 ‘견고한 군인정신의 함양’을 행형이념으로 법제화하여 건전한 시민으로의 재사회라는 민주적 교육형주의와 배치되는 강력한 군사주의적 교육형주의가 지배하였다. 그 결과 교정의 군사화, 병영화, 밀행화, 비전문화 등으로 인한 인권문제와 재범률 등의 문제가 제기되어 오다가 문민정부와 인권적 추세 속에 2007년 군 행형법이 전면 개정되면서 군사주의적 교육형주의의 근원이었던 ‘견고한 군인정신’을 삭제하고 ‘건전한 사회복귀’를 군 교정의 이념으로 법제화하였다. 2014년에는 국군교도소로 통합되면서 과거보다 인권문제가 많이 개선되었다. 그럼에도 군교도소의 인권문제와 교화에 관해 여러 문제가 제기되어 왔고 이에 선행연구들은 군교도관의 전문성 제고 등의 미시적 측면에서 개선방안을 제시하였다. 그러나 선행연구들은 형식적 교육형주의를 취하는 군 교정레짐의 하부구조에 오랜 군사주의 문화와 응보적 권위주의의 잔재가 강력하게 응집된 한국 특유의 군사주의적인 보안지상주의적 교정레짐이 강력하게 작용하고 그 영향을 미치는 거시적 측면의 문제점을 간과하고 있다. 또한 미시적 측면에서도 군사회복지, 군교정복지 등의 접근방법을 간과하고 있다. 따라서 군교정의 문제점을 교화이념, 교화주체, 교화조직, 교화프로그램 등의 교정레짐에서 미시적 측면과 거시적 측면에서 접근하여 군교도관의 전문성 등의 미시적 개선방안 외에 군교도소의 폐지 등 거시적 개선방안을 제시하였다.

영문 초록

Until the end of 1950s, korean military prison founded in 1949 has more retributivism than correction ideology for them. The law on the execution of sentences and the treatment of military prisoners which was established under the Park Chung-hee administration based on strong anti-communism and militaryism defined the cultivation of strong military spirit as a correction ideology for them and military educational ideology that ran counter to the democratic ideology of re-socialization dominated the korean military prison. Therefore, human rights and so on issues have been raised due to the militarization of correction, the secrecy of correction, non-specialism of correction and so on. educational correction based on wholesome return to society for them was stated as ideology of military prisoners correction with the sweeping revision of the law on the execution of sentences and the treatment of military prisoners in 2007 in the civilian administration and human rights trends. The human rights issues has improved a lot with the merger of the military prison in 2014. Nevertheless, various problems have been raised regarding the correction of military prison and human right of them and so on. Therefore, existing studies have proposed of the improvement device in terms of micro aspects of the professionalism of military prison officers and so on. But they passed over micro aspects which have been affected by long-military culture and korean characteristic military securitic correction regime which has deeply imbed with retributivism remnants and military authoritarism and military social welfare in micro aspects. Therefore, I asserted macro improvement devices of military correction regime including ideology, actor, administration, programs and so on. Throughout micro aspect and macro aspect of abolition of military prison and so on.
