노인학대의 개념 및 유형에 관한 입법방안

국문 초록

우리나라는 고령사회에 진입함에 따라 노인문제가 중요한 국가적･사회적 이슈가 되고 있다. 특히, 노인의 수명이 연장되면서 노인학대도 증가하고 있으며, 심각한 사회적 문제가 되고 있다. 이에 근래에 들어 정부는 노인학대를 국가적 문제로 인식하고 적극적인 대처방안을 강구하고 있다. 그러나 법률의 측면에서 보면 흉악한 노인학대 사례가 발생할 때마다 ｢노인복지법｣의 일부 규정들의 신설･개정을 통해 임시방편적으로 대처하는 모습에서 벗어나지 못하고 있다. 이러한 연유로 인하여 사회복지법인 ｢노인복지법｣은 그 명칭이나 성격과 달리 노인학대에 관해서는 사법적 조치에 대한 내용들을 포함하고 있는 등 체계상으로나 내용적으로 문제점을 가지고 있다. 더구나 ｢노인복지법｣에서는 노인학대의 구체적 유형에 대한 기술도 없을 뿐만 아니라 가장 기초적인 개념인 ‘학대행위자’ 또는 ‘피해노인’에 대한 개념 정의도 제대로 되어 있지 않다. 따라서 ｢노인복지법｣이 노인학대의 방지와 피해노인의 보호를 위한 법률로서 충분히 기능할 수 있을지 의문이다. 이에 본고에서는 중앙노인보호전문기관의 개념 정의 및 선행연구들에 대한 검토를 기초로 하여, 노인학대의 개념과 유형 및 노인학대 관련 용어들에 대하여 구체적인 입법방안을 제시함으로써 관련 법률의 개정을 촉구하였다.

영문 초록

As Korea enters an aging society, the elderly issue is becoming an important social issue, and the interest of the general public is also intensifying. In particular, as the life span of the elderly is extended, the abuse of the elderly is increasing, and it is becoming a serious social problem. In recent years, the government has been actively seeking measures to cope with elder abuse by treating it as a national problem. However, in terms of the law, it has not escaped from the temporary response to the geriatric system through the establishment and revision of some regulations under the Welfare of Senior Citizens Act. For this reason, unlike its name, the Welfare of Senior Citizens Act has some contentious problems, including the contents of judicial measures against elder abuse. Moreover, not only does the Welfare of Senior Citizens Act have no specific description of the types of elder abuse, but it also does not have a proper definition of the concept of “elder abuser” or “victim of elder abuse.” Therefore, it is questionable whether the protection of the affected elderly and the provision of services to the abusers will be realized properly through the revision of the Welfare of Senior Citizens Act as well as the prevention of abuse against the elderly. Based on the definition of the Central Elder Protection Agency and prior study on elder abuse, this school proposed specific legislative measures for the concepts and types of elder abuse and terms related to elder abuse.
