국문 초록

우리 민법은 자연인과 법인을 권리주체로 인정하고 있다. 즉, 자연인과 법인은 법인격을 가지며, 권리와 의무의 귀속주체로써 완전한 권리능력을 가진다. 법인격에 대한 관념은 인간의 평등과 존엄성에 기반을 둔 것으로써, 근대 민법에서 법인에게로 확대되었다. 그런데 법인격에 대한 이러한 통설적 설명은 오늘날 많은 도전을 받고 있다. 권리능력이 상대화거나 부분적으로만 인정될 수 있는 것인지에 관한 문제, 권리주체에게 귀속되는 권리능력과 의무능력이 서로 분리될 수 있는 것인지의 문제, 법률에 의해 인정된 법인의 법인격이 법률에서 규정되지 않은 사유에 의해서도 부인될 수 있는지와 법인의 권리능력은 설립목적 범위 내에서만 인정되는 것인지의 문제, 자연인과 법인 외에도 인공지능 로봇이나 동물 등에 대해서도 법인격을 인정할 수 있는 지의 문제 등이 그것이다. 본고는 이러한 문제의식을 가지고서 법인격 개념의 형성과 발전 혹은 도전에 대해 고찰하고자 작성되었다(Ⅰ). 법인격과 관련하여 최근에 제기되는 문제들에 답하기 위해서는 법인격 개념이 법제사적으로 어떻게 형성되고 현재까지 어떻게 발전되어 왔는지에 살펴볼 필요가 있다. 이에 본고는 Ⅱ.에서 법인격의 형성과정에 대해 법제사적 관점에서 고찰해 보았다. 이를 바탕으로 Ⅲ.에서는 최근 법인격에 대해 제기되는 새로운 도전적 과제들에 대해 개괄하면서 필자의 견해를 개진하였다. Ⅳ.에서 필자는 결론적으로 인간중심적 인격에 기반한 전통적인 법인격 개념은 오늘날에도 여전히 유효하며, 인공지능 로봇이나 동물에 대해서도 법인격을 인정하려는 탈인간중심적 인격개념에 대해서는 회의적인 입장이다.

영문 초록

The Korean Civil Code recognizes natural person and legal entity as subjects of rights. In other words, natural person and legal entity have respectively legal personality and have complete legal capacity as legal subjects to which rights and obligations belong. The idea of a legal personality is based on the equality and dignity of human beings and has been extended to legal entities in the modern civil code. However, this orthodox explanation of legal personality is being challenged today. The question of whether legal capacities are relativizable or only partially recognizable, the question of whether the rights and obligations attributable to the legal subject can be separated from each other, the question of whether the legal personality of a legal entity recognized by law can be denied even for reasons not stipulated in the law and whether the legal capacity of a corporation is recognized only within the scope of the purpose of its establishment and the question of whether legal personality can be recognized not only for natural persons and legal entity, but also for artificial intelligence robots and animals are the recently rising issues. This paper was written to consider the formation, development or challenge of the concept of legal personality with such a sense of problem(Ⅰ.). In order to answer the recent questions related to legal personality, it is necessary to examine how the concept of legal personality was formed in the legal historical context and how it has been developed. Accordingly, this paper examines the formation process of legal personality in II. from the point of view of legal history. Based on this, in Ⅲ. the author presented the views by outlining the new and challenging tasks that have been recently raised for legal personality. In Ⅳ. the author concludes that the traditional concept of legal personality based on human-centered personality is still valid today, and he is skeptical of the post-human-centered concept of personality that attempts to recognize legal personality even for artificial intelligence robots and animals.
