건축물관리의 규제평가요소분석 및 사례연구*

국문 초록

건축물의 안전 등에 관한 법적인 영역에서는 건축법과 건축물 관리법, 령, 시행규칙에 명시되었다. 그러나 법, 령, 규칙을 3단 비교분석 결과 아직도 위임 및 시행될 사항이 조례에 반영이 늦어져서 시행상 안전 등의 문제가 대두되고 있다. 이러한 사항은 건축물의 규제에 관한 평가요소를 투명화, 구체화, 계량화 등을 통하여 좀 더 건축물의 안전성 등을 확보할 수 있도록 평가요소 항목의 필요성이 증대되고 있다. 따라서 본 논문에서는 건축물 관리법 제정에 따라 법에서 위임한 사항과 그 시행에 필요한 사항 규정에서 규제평가요소 지표에 대한 선행연구를 토대로 표준화된 평가요소를 도출하고자 하였다. 또한, 천안시의 규제평가요소 분석을 통하여 규제의 영향분석에서 규제분석서 작성과 조례제정까지의 절차를 사례로 연구하였다. 도출된 규제평가 요소의 현황분석을 토대로 새로운 규제평가요소 항목을 제시하였다. 제시된 평가항목을 통하여 좀 더 객관화, 투명화된 규제의 완화나 강화를 통하여 정형화되고 표준화를 시도하였다. 결론적으로 규제평가요소 분석을 통한 신지표를 개발하여 건축물의 미관과 안전성 확보 등에 본 논문이 시사하는 바가 매우 크다 할 것이다.

영문 초록

In the legal area of safety of buildings, it was specified in the Building Act, the Building Management Act, the Ordinance, and the Enforcement Regulations.,However, as a result of the three-stage comparative analysis of laws, ordinances and rules, the matters to be delegated and enforced are still delayed in the ordinance, and safety issues such as enforcement are emerging.,These matters are increasing the necessity of evaluation element items to secure more safety of buildings through transparency, concreteness, and quantification of evaluation elements related to the regulation of buildings.,Therefore, this study aims to derive standardized evaluation factors based on the preceding studies on the regulatory evaluation factor indicators in the regulations delegated by the law and necessary for the implementation of the building management law.,In addition, through the analysis of regulatory evaluation factors in Cheonan city, the study examined the procedures from the analysis of the impact of regulations to the preparation of regulatory analysis and the enactment of ordinances. Based on the analysis of the current status of the deduced regulatory evaluation factors, a new regulatory evaluation factor item was presented.,Through the proposed evaluation items, the standardized and standardized study was attempted through the relaxation or strengthening of more objectification and transparent regulation.,In conclusion, this paper suggests that the aesthetics and safety of buildings are secured by developing new indicators through analysis of regulatory evaluation factors
