국문 초록

자본주의 경제체제가 지배적인 현대에서의 공직자는 합리적 경제인임과 동시에 공익의 수호자라는 이중적 지위 속에 놓여있다. 그렇기에 개인적인 이익과 국가적 차원에서의 공익에서의 괴리에서 기인하는 이해관계의 충돌 상황이 빈번하게 발생한다. 물론 이해충돌 상황이 존재하는 그 자체는 부도덕한 것이 아니다. 하지만 이에 대헌 적절한 통제와 관리 또는 법적인 제재가 부재하다면 공직자의 선택은 개인에게 이익이 되는 쪽을 선택할 가능성이 높다. 이제까지는 이해충돌의 모호성 때문에 또는 이를 묵시적으로 허용하는 관습적 행태 때문에 이해충돌 상황을 방치하였다. 이제는 민주화를 이룩한 국내적 상황과 이해충돌의 방지 및 관리의 법적 규범 정립이라는 국제적 차원에서의 요구에 부응할 때다. 물론 우리나라도 윤리적·법적 차원의 법규 체계가 다양하게 마련되어 있다. 다만 이해충돌방지법은 여러 현실적인 이유로 시행하지 않고 있다. 이를 시행하기 위해서는 국회의 역할이 필수적으로 요구되는 바이다.

영문 초록

In the modern era where the capitalist economy is dominated, public officials are in the dual position of being both rational businessmen and guardians of the public interest. Therefore, conflict of interests arising from the gap between personal interests and public interests at the national level frequently occurs. Of course, the existence of a conflict of interest situation itself is not immoral. However, in the absence of appropriate controls and management or legal sanctions, the choice of public officials is highly likely to be in the interest of individuals. Until now, conflict of interest situations have been neglected either because of the ambiguity of the conflict of interest or because of the customary behavior that implicitly allows it. Now is the time to meet the demands at the international level of the domestic situation that has achieved democratization and the establishment of legal norms for the prevention and management of conflicts of interest. Of course, Korea also has a variety of legal and regulatory systems at the ethical and legal level. However, the Conflict of Interest Prevention Act has not been implemented for a number of practical reasons. In order to implement this, the role of the National Assembly is essential.
