국문 초록

토지와 건물과의 관계에 관한 연구주제는 분명히 매력적이다. 세계공통법의 성격이 짙은 채권법과 달리 물권법은 각 나라마다 부동산에 관한 역사적 발전을 달리하고 있고 특유한 관습과 전통에 얽매여 보편적이지 않다는 점을 감안하더라도 우리민법이 매우 특이한 구성을 취하고 있기 때문이다. 우리의 모법이 되는 서구유럽의 법률은 “지상물은 토지에 따른다(superficies solo cedit)”라는 로마법의 법언에 따라 토지와 건물을 일체적으로 취급하지만, 우리민법은 토지와 건물을 별개의 부동산으로 보아 토지위의 건물에 대해서는 부합의 법리가 적용되지 않으며, 양자의 권리변동은 별개로 이루어진다. 이에 따라 토지와 건물이 별개로 양도･상속되거나 담보되기 때문에 권리관계가 복잡할 뿐만 아니라, 건물철거라고 하는 사회･경제적 비용손실이 발생할 염려가 있다는 것은 주지의 사실이다. 이 글은 이러한 문제의식으로부터 출발해서 ⅰ) 우리민법이 토지･건물의 개별･독립적 구성을 취하는 연유는 어디에서 비롯된 것인지 ⅱ) 현행 개별･독립적 구성의 문제점은 무엇인지 ⅲ) 가설로서 토지･건물의 일체적 구성을 취할 경우 어떤 점이 해소되고 어떤 점이 남는지, 새로이 발생되는 문제가 무엇인지를 법적, 사회･경제적 관점에서 검토하였다. 법이론상으로는 일체적 구성을 취하는 것이 권리관계가 간명해지고 사회･경제적 측면에서도 건물철거로 인한 사회･경제적 비용손실을 방지할 수 있으며, 무엇보다도 현행법제하에서는 토지와 건물의 소유를 분리시킴으로써 토지소유자와 건물소유자의 이익이 충돌되고 따라서 양자의 이해관계를 어떻게 조정할 것인지가 문제되었으나 이에 대한 근원적인 해소가 가능해진다. 그러나 현행 개별･독립적 구성에서 어떻게 토지･건물의 일체적 구성으로 전환조치할 것인지의 문제가 남으며, 이에 대한 심도있는 연구는 향후의 연구과제로 한다.

영문 초록

Above all, under the current law, the interests of landowners and building owners conflict by separating the ownership of land and buildings, and thus how to adjust the interests of both parties, but the fundamental solution is possible.The research topic on the relationship between land and buildings is clearly attractive. This is because the Korean Civil Law takes a very peculiar composition, even considering that unlike the law of obligations, which has a strong nature of the world common law, in the case of real rights law each country has different historical developments in real estate and is not universal due to its unique customs and traditions. The Western European law, which is our parent law, treats land and buildings as a whole in accordance with the Roman law of “superficies solo cedit(things attached to land become part of it)”, but the Korean Civil Law treats land and buildings as separate real estate, and does not apply the law in conformity with the buildings on land, and the changes in rights of both parties are made separately. Accordingly, it is a well-known fact that the relationship between rights is complicated because land and buildings are transferred, inherited, or secured separately, and there is a risk of loss of social and economic costs such as building demolition. This article started with this awareness of the problem and examined from legal, socio-economic perspectives i) Why does the Korean Civil Law take the individual/independent composition of land and buildings? ii) What are the problems of the current individual/independent composition iii) if the unified composition of land and buildings was adopted as a hypothesis, what would be resolved and what would remain. In legal theory, taking an integral composition makes the relationship of rights simpler and prevents loss of social and economic costs due to the demolition of buildings from social and economic aspects, and above all, under the current law, the interests of landowners and building owners conflict by separating the ownership of buildings from the land, and thus, how to adjust the interests of the two has been a problem, but the fundamental solution to this becomes possible. However, there remains a question of how to take measures from the current individual/independent composition to an integral composition of land and buildings, and the research on this remains a future research project.
