강력범죄 피해자의 법정증언 경험에 대한 연구: 피해자와 실무자의 보고를 중심으로

국문 초록

본 연구는 강력범죄 피해자의 증언경험을 탐색하는 것을 목적으로 하였다. 이를 위해 피해자 설문조사와 실무자 심층면담을 실시하였다. 그 결과, 증인출석사유에 대한 설명정도가 형사사법절차에 대한 지각된 공정성 및 절차 만족도와 유의한 상관이 있었다. 차폐막 설치요청은 대부분 수용되었고, 비공개재판은 성폭력 사건에서만 허용되었다. 신문 중 판사 및 검사에 대한 경험이 비교적 긍정적인 것과 달리 피고 측 변호사에 대한 경험은 매우 부정적 이었다. 모든 피해자가 법정증언 직후 PTSD 진단기준을 충족할 정도의 충격을 경험하였으며그 심각도는 증인출석사유 설명정도, 질문이해도, 변호인의 태도 및 반대신문 방식과 유의한상관이 있었다. 범죄유형에 따른 차이는 유의하지 않았으며, 가해자가 낯선 사람인 경우 충격이 유의하게 심각한 것으로 나타났다. 실무자면담 결과 17개 의미주제가 도출되었으며, 피해자의 경험보고와 대부분 일치하였다. 이러한 결과를 종합하여 연구의 시사점 및 제한점에대해 논의하였다.

영문 초록

This study aims to investigate the experiences of testimony of victims of violent crimes and to find ways to protect victim witnesses based on the results. For this aims, a survey of victims and in-depth interview of victim supporters were conducted. As a result, the level of explanation of the reasons for attendance of witnesses was positively correlated to the overall satisfaction with criminal justice procedures and the degree to which the criminal justice procedures were fair. In contrast to the positive experience of judges and prosecutors, the experience of defense attorneys was very negative. All the victims experienced a shock to meet the PTSD criteria after the testimony, and the severity was significantly correlated with the degree of explanation of the reason for the testimony and the understanding of the question, the attitude of the defendant s lawyers, and the cross-examination method. The difference in severity according to the crime type was not significant, and the shock was significant when the offender was a stranger. Analysis of the statements made by victim supporters resulted in 17 theme. The implications of the finding, suggestions about the violent victim witness protection, and limitation of current study have been discussed.
