국가화재안전기준(NFSC)의 제·개정 시스템 개선에 관한 연구

국문 초록

화재안전기준은 소방시설법 시행령 별표1에서 규정하고 있는 소방시설에 대한 설치방법 및 기술적 기준을 규정한것으로 공공의 안전확보와 화재예방을 위한 근간으로서 그 역할을 수행하여왔다. 그러나 현행의 화재안전기준은 성능 기준과 기술기준이 혼재되어있는 형태로 장기간의 개정 절차와 제도적인 경직성으로 인해 기준의 제·개정이 신속하게 진행되기 어렵다. 또한, 기준을 제·개정하고 유지관리 할 수 있는 전문적 상임 독립기구의 부재로 인해 전문성 유지에 한계가 있으며 그 외에도 총의(總意)성, 공개성, 일관성이 결여되는 문제가 있다. 따라서, 이러한 문제점을극복하기 위해 본 연구에서는 화재안전기준의 변천 및 운영 현황, 법적 성질 및 법적 현황 그리고 제·개정 시의문제점을 살펴보고 국내·외 유사 기술기준의 운영사례를 비교 분석하여 화재안전기준의 제·개정 시스템을 개선하고자 하였다. 이것을 나타내면 다음과 같다. 첫째, (現)국가화재안전기준을 법적 성능 기준과 기술적 세부기준인 기술기준으로 분류한다. 둘째, 기술기준의 제·개정 주체를 기존의 국가에서 민간으로 이양시킨다. 셋째, 기술기준을사용자 중심의 코드 시스템으로 정비하는 것이다.

영문 초록

The National Fire Safety Code (NFSC) sets forth the installation methods and technical standards of firefighting facilities. This information is stipulated in the attached Table 1 of the Enforcement Decree of the Act on Fire Prevention andInstallation, Maintenance and Safety Control of Fire-Fighting Systems. The NFSC serves as a foundation for fire preventionand public safety. However, the current version of the NFSC has been under scrutiny due to its delayed enactment andrevision process. This is because of its structural inflexibility, time-consuming procedures, and mixed usage of bothperformance and technical standards. Furthermore, there are difficulties with keeping its unique specialties due to theabsence of a specialized, permanent independent entity that enacts, revises, and maintains its standards. Moreover, the NFSClacks collectivity, openness, and consistency. Therefore, to overcome the aforementioned obstacles, this study investigatesthe operational and legal status of the NFSC and the problems regarding its enactment and revision process. Further, itpresents suggestions for system improvement by analyzing and comparing the information with domestic and foreigncounterparts dedicated to managing their similar technical NFSC standards. First, the study recommends that the legalperformance and technical standards mixed within the current NFSC should be separated. Second, the enactment andrevision of technical standards should be implemented by the private sector and not by the government. Third, technicalstandards should adopt a user-oriented approach for the code system.
