문재인 정부 2년 반, 법치주의의 성과와 과제

국문 초록

문재인 정부는 집권 초기에 높은 지지율을 보이면서 적폐청산, 검찰개혁, 사법개혁을 통한 법치발전을 추구했다. 하지만 임기의 절반이 지난 현시점에서 오히려 법치의 후퇴를 우려하는 목소리가 커지고 있다. 과연 문재인 정부 2년 반 동안 법치주의는 어떤 성과를 보였고, 과제를 남겼는가를 평가하기 위해 먼저 법치주의의 실현구조와 평가지표에 대해 간단히 정리한 후에 문재인 정부 2년 반 동안의 법치주의를 평가하기 위해 가장 대표적인 분야로 적폐청산, 검찰개혁, 사법개혁을 각기 검토해 보았다. 초기에 국민의 호응이 뜨거웠던 적폐청산은 적절한 시기에 적폐청산을 마무리하지 못함으로써 그 취지와 정당성이 퇴색되었다. 적폐청산의 의미와 방식 등에 대한 국민적 동의를 얻기 위한 노력이 부족했으며, 적용 대상 및 기준의 일관성이 결여됨으로써 동력을 상실하게 된 것이다. 검찰개혁은 현재진행형이다. 그러나 제1야당인 자유한국당의 강한 반대에 직면해 있을 뿐만 아니라, 공수처법의 내용에 대한 비판에도 불구하고 공수처를 도입하는 것이 곧 검찰개혁의 성공인 것처럼 주장하는 것은 타당하지 않다. 사법개혁은 아직도 과제로 남아 있다. 하지만 대법원에서 마련된 사법행정회의 안에 대해서는 전문가들의 비판이 매우 날카로우며, 법원 내부에서의 이견도 적지 않은 것으로 알려지고 있다. 이러한 법치 분야의 성과가 충분치 못하다는 것만으로 문재인 정부를 전체적으로 평가하기는 어렵다. 그러나 주목할 점은 민주정치와 법치가 상호 의존적이라는 점이다. 민주적 정치과정을 통해 법이 만들어지지만, 이렇게 만들어진 법은 정치과정을 통제한다. 이러한 상호 의존 및 상호 통제를 통해 정치와 법치는 올바른 방향으로 나아갈 수 있기 때문이다. 법치를 도외시한 정치는 독재정치 또는 중우정치에 빠지기 쉽다. 설령 민주주의에 투철한 정치인들이라 할지라도 자신도 모르는 사이에 포퓰리즘의 늪에 빠지기 쉽다. 문재인 정부도 이제는 스스로를 돌아보면서 점점 치열해지는 정치적 갈등 속에서 법치가 올바른 방향을 제시하지 못하고 있다는 점을 인식하면서 이를 해결하는 것은 남은 임기 동안의 가장 중요한 과제의 하나로 삼아야 할 것이다.

영문 초록

The Moon Jae-in administration showed high approval rate in the early days of the administration and pursued development of rule of law through eradication of deep-rooted evil, prosecution reform and judicial reform. However, at the present half of the term of office, there is a growing concern over the rule of law. In order to evaluate the achievements of the rule of law in the two and a half years of the administration of Moon Jae-in, briefly summarized the realization structure and evaluation indicator of the rule of law. The most representative field for evaluating are eradication of deep-rooted evil, prosecution reform and judicial reform. The eradication of deep-rooted evil, which was initially popular with the public, failed to complete in a timely manner. Efforts to obtain public consent on the meaning and method of liquidation of redundancy were lacking. The lack of consistency in the application targets and standards led to the loss of power. Prosecution reform is ongoing. But it faces strong opposition from the first opposition Liberal Korea Party. In addition, despite criticism of the content of the the Independent Investigative Agency Act, it is not reasonable to argue that introducing the Independent Investigative Agency is the success of the prosecution reform. Judicial reform remains a challenge. But criticism from experts is very sharp on the judicial administrative council set up in the Supreme Court. There are also many disagreements within the courts. It is difficult to evaluate the Moon Jae-in government as a whole just because the results of this rule of law are insufficient. It is important to note, however, that democracy and the rule of law are interdependent. Laws are created through democratic political processes, but these laws govern political processes. This interdependence and mutual control allows politics and the rule of law to move in the right direction. Politics neglecting the rule of law are likely to fall into dictatorships or ochlocracy. Even politicians who struggle with democracy are prone to populism without knowing it. The Moon Jae-in administration should now look back on itself and realize that the rule of law is not giving the right direction in the face of increasingly fierce political conflict.
