인터넷서비스제공자가 보관한 정보에 대한 압수·수색 절차

국문 초록

현대사회는 스마트폰 보급의 확대로 트위터 등 SNS, 모바일 뱅킹, 이메일 등 다양한 인터넷 서비스를 손 안에서 이용할 수 있게 됨에 따라 우리의 생활이 물리적인 장소 또는 국내 네트워크에 한정되지 않고, 페이스북(facebook), 유튜브(YouTube), 구글(Google) 등 해외 인터넷서비스제공자의 서비스 이용을 통한 네트워크까지 확대되었음을 의미한다. 이는 곧 범죄자들의 범행방법, 범죄수익 등과 관련된 증거 역시 인터넷 상에 전자정보로 보관되며, 더욱이 범죄의 증거가 국내 네트워크를 넘어 해외 서버에 저장된 경우도 있음을 의미한다. 따라서 해외 인터넷서비스제공자를 포함하여 인터넷서비스제공자가 보관 정보에 대한 현행 압수·수색절차가 적절한지 검토할 필요가 있다. 우리 형사소송절차는 아직까지도 유형의 물건에 대한 압수를 전제로 규정되어 있는바, 4차 산업혁명 시대에 맞는 법이 아닐 뿐만 아니라 이와 같은 규정으로는 수사의 효율성을 담보하기 어렵다. 더욱이 이메일 등 제3자가 보관한 정보에 대한 압수·수색절차에 있어 피의자가 아닌 정보주체의 참여권 등의 권리도 충분히 보호되지 않고 있다. 제3자 보관 정보의 특성을 반영하여 전자영장제도의 도입, ISP의 협력의무 및 이의절차 규정 도입, 영장의 전자적 제시 허용 등을 통하여 수사의 효율성을 도모함과 동시에 피압수자 및 정보주체의 권리를 함께 보호할 수 있도록 형사소송 절차를 개정할 필요가 있다.

영문 초록

As the use of smartphones increases, the modern society has enabled not only text messaging but also various Internet services such as SNS and e-mail, including mobile banking. The increase in the number of smartphone users has led to the expansion of living space through networks that cross domestic and overseas. In other words, various evidences about criminals crimes, concealment of crime profits, and evidences of crimes are also stored as electronic information on the network. Therefore, it is necessary for third parties, including overseas Internet service providers, to review the seizure and search procedures for archived information. However, our criminal procedure is still premised on the seizure of goods, which is not suitable for the Fourth Industrial Revolution, and it is difficult to secure the efficiency of investigation. Moreover, in the seizure and search procedures for information stored by third parties such as e-mail, it is difficult to protect the rights of the information subjects because the procedures for guaranteeing the right of participation of the information subjects other than the suspects are also insufficient. It is urgent to revise criminal proceedings to reflect the nature of Internet Service Provider Archiving information.
