무인항공기에 대한 경찰규제 방안

국문 초록

민간 분야에 있어서 드론의 경우 영리목적을 위한 상업적 드론 사용에 대한 입법 선진화가 지속적으로 이루질 것으로 예상된다. 그러나 레저스포츠나 비상업적 항공촬영 등 사인(私人)에 의한 비영리적 드론 사용이라 하더라도 사용자의 조종 미숙 및 기타 기술상의 결함 등으로 인하여 사고발생을 예견할 수 있으며, 그에 대한 사전 예방장치로서의 규제 입법 또한 필요하다고 할 수 있다. 사고 발생에 따른 배상책임의 법리적 해석이 다른 일반법상 가능하다고 할 수 있지만, 사고 원인규명과 책임소재 파악 및 입증을 원활히 하기 위하여 드론 사용자의 사전 등록 및 신고번호 표시제를 도입하여야 하며, 특히 제조 및 개발업자에 대한 신고 또는 허가 규정을 마련하여 제조 책임의 명확화를 이루어야 할 것이다. 그리고 항공법에서 제외된 드론이라 하더라도 조종자격 및 요건을 마련하고, 사전 교육을 필수적으로 이수하도록 하여 안전사고 등 방지를 위한 조종자 및 소유자의 책임을 강화하여야 한다. 관리ㆍ감독 기관에 있어서 단속적 감시와 행정입법의 원활한 집행을 위해 그 주체는 경찰조직이 가장 합당하다고 보며, 이에 대한 근거규정을 마련하기 위한 개별 입법이 필요하다고 본다. 이를 위해서는 경찰규제의 실효성을 확보하기 위한 입법방향과 항공법 등 기존 관련 실정법과의 상충을 방지하기 위한 입법 정책적 대안이 제시되어야 하며, 드론의 기술적 특성을 고려한 규제방안에 대해 후속연구가 이루어져야 할 것이다.

영문 초록

In the private sector, drones are expected to continue to advance legislation on commercial drones for commercial purposes. However, even if non-commercial drones are used by private individuals such as leisure sports or non-commercial aerial photographs, it is possible to anticipate the occurrence of accidents due to inexperienced users and other technical defects, and regulatory legislation as a precautionary device is also required. However, in order to identify the causes of accidents and to facilitate identification and verification of liability, it is necessary to introduce the pre-registration of drone users and the declaration number indicator system. In particular, It is necessary to clarify the manufacturing responsibility by preparing the declaration or permission regulations for the developer. Even if the drones are excluded from the aviation law, it is necessary to prepare the pilot qualifications and requirements, and to take the preliminary training in order to strengthen the responsibility of the pilot and the owner to prevent safety accidents. In order to ensure smooth implementation of interim monitoring and administrative legislation in the supervisory and supervisory bodies, the police organization considers the subject to be the most appropriate, and it is necessary to have individual legislation in order to establish the basis for the regulation. For this, a legislative policy alternative to prevent the conflict between the legislative direction to ensure the effectiveness of the police regulation and the existing related laws such as the aviation law should be presented, and further study on the regulation method considering the technical characteristics of the drone should be done.
