개정사립학교법의 헌법적 주요쟁점

국문 초록

우수한 인적자원의 양성은 국가경쟁력의 핵심이 된다. 인적자원 양성의 중심 역할을 하는 학교교육이 다른 분야에 비하여 상대적으로 폐쇄적으로 운영되고 국제경쟁력이 가장 낙후된 분야로 지적되고 있다. 상당한 비중을 차지하고 있는 사립학교의 경우 폐쇄성이 심하여 재단이사회의 개방적 운영을 내용으로 하는 사립학교법이 개정되어 2006년 7월부터 시행된다. 본 논문은 사립학교법 개정의 주요 내용을 살펴보고, 이러한 개정 내용 중 위헌시비가 제기된 중요쟁점들을 헌법적 차원에서 분석하였다. 분석된 중요쟁점은 개방형이사와 감사선임, 임원취임의 승인취소사유 확대와 임원의 직무집행정지, 임시이사 선임요건 완화와 정이사 전환, 이사장 겸직금지와 친족의 학교장 임명금지, 학교장의 임기제한, 대학평의원회설치, 시행일규정, 입법과정이다. 이러한 쟁점분석에 직접 관련되는 선결과제가 사립학교의 법적 성격이므로 이에 관한 다양한 견해들도 살펴보았다. 마지막으로 한나라당이 제출한 개정안을 소개하며 재개정시 여야가 타협하여 위헌성을 피하도록 유의사항을 제시하였다.

영문 초록

The key to the future of our national strength is dependent upon the excellence of our human resources. The school system, particularly private, cultivating human resources in Korea has been operating in a closed system, resulting in low ranking in terms of international competitive power. The private school law amended recently to operate openly has exposed critical conflicts in Korean society. This article reviewed the amended contents and analyzed critical issues on the unconstitutionality of the amended articles. One of the critical issues is that one quarter of the board of trustee should be recommended from the school governing committee or university faculty meeting. It could be unconstitutional because it may infringe on the legal autonomy of the board of trustees. This article also reviewed diverse opinions on the legal nature of the private school, because it is directly related to the unconstitutionality of the coerced recommendation of one quarter of the trustees. The alternatives suggested by the opposing party also introduced. Compromise between the parties should be made within the constitutionality of the private school law.
